Introduction

An announced routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance with a focus on health and hygiene practices during the COVID-19 pandemic.

Contraventions
Previous Inspection - Contraventions observed on FIR #MMAK-BHNQCP have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10020 - CCLR s.10(2)(a) - Licensees must not make any structural change to a community care facility unless the licensee first (a) submits plans for the change to a medical health officer.
Observation: Licensing observed that a shed has been added to the outdoor play space without Licensing approval or notification.
Corrective Action(s): Ensure that structural changes to a community care facility are not made unless a plan has been submitted to Licensing and written approval has been obtained.

LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The manager's name was not posted in the care facility.
Corrective Action(s): Ensure that the manager's name is displayed in a prominent place in the community care facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following:
- Bi Fold closet doors through out the facility that can pose a pinching hazard. One of the closet doors had a child safety lock on it, but could be opened to cause a gap large enough to pose a pinching hazard.
-Children's nap mats were stored in a way that they were touching causing the children's bed linens to be in contact with each other.
Corrective Action(s): Ensure that healthy and safe environment is provided at all times.

STAFFING: 12450 - CCLR s.60(3)(a) - A licensee must keep (a) in the case of employees, all records required under section 19 (1) [character and skill requirements] for the entire time that the subject of the records is an employee of the community care facility.
Observation: Staff records for the Manager could not be produced for inspection.
Corrective Action(s): Please ensure that all records required under section 19 (1) are available for inspection the entire time that the subject of the records is an employee of the community care facility.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Licensing reviewed 6 children's files and noted that one file was missing a declaration of immunization status.
Corrective Action(s): Ensure that children's records are complete.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Upon a review of 6 children's files, Licensing observed that 2 files did not have emergency contacts other than the children's parents.
Corrective Action(s): Ensure that children's files are complete and include an emergency contact other than children's parents.

Comments

Summary of Inspection:
At the inspection dated August 12/20, there were 6 children in care with the Manager.
A COVID-19 Risk Screening was conducted before the inspection.
At the inspection, the above noted contraventions were identified.
Please provide Licensing with a written response, by the date noted below, stating how the identified contraventions will be addressed in order to ensure year round compliance.
As part of this Routine Inspection a Facility Risk Assessment Tool was completed.
This report was written off site due to COVID-19 safety practices. The contraventions and summary items identified in the report were reviewed with the Manager before Licensing's departure. A signature was not obtained due to COVID-19 safety practices.
A copy of the report and the corresponding Risk Assessment was emailed to the Manager.
The following items were discussed:
-Planned emergency response during COVID-19.
-Communicable disease prevention practices.
-Health/hygiene/sanitizing practices during COVID-19 which included review of cleaning and sanitizing as multiple steps and review of proper diapering practices.
-Medicated items in first aid kits require parental consent.
-Manager indicated that they do not go off site for community walks often but when they do, children's files are taken with them as the facility does not use emergency cards and does not have an alternate system of recording children's information.
-A COVID-19 safety plan for children is posted. The Manager has been informed of the requirement of a COVID-19 safety plan for staff to be developed and posted as well.
-Manager indicated that children's food is provided by the parents.
