Introduction

An unscheduled routine inspection was conducted on May 6, 2022 to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were reviewed for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Upon inspection the staff's certificate was not displayed.
Corrective Action(s): Please ensure the staff Licence is displayed in a prominent place in the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Upon inspection, there was:
- a blind cord accessible to the children
-pile of broken fencing outside accessible to the children
-a fountain cord hanging that posed a strangulation hazard
-sharp metal fencing accessible to the children
* This is a repeat contravention*
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times that children are in care

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Upon inspection there was a large bucket of water accessible to the children that posed a drowning hazard.
Corrective Action(s): Please ensure standing water is removed from yard.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one or more employees.
Corrective Action(s): Please ensure staff files are complete

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Upon review of the staff files, 1 staff did not have their Licence validated by the Early Childhood Registry.
Corrective Action(s): Please ensure staff files are complete.

CARE AND/OR SUPERVISION: 14010 - CCLR s.34(1) - A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation: Upon inspection, the staff had left the children unsupervised indoors to come outside during the inspection.Licensing requested that staff go back inside to supervise the children.
Corrective Action(s): Please ensure supervision is maintained at all times children are in care.

RECORDS AND REPORTING: 19050 - CCLR s.56(1)(f) - A licensee must keep current records of each of the following: (f) a log of minor accidents, illnesses and unexpected events involving children, that did not require medical attention and were not reportable incidents described in Schedule H.
Observation: Upon inspection staff did not know where the minor incident log book was kept.
Corrective Action(s): Please ensure a log of minor incidents is kept and able for review.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Upon inspection of the children's records,1 did not have an enrollment date.
Corrective Action(s): Please ensure the children's records are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Upon review of the attendance records, 2 departure times had not been recorded.
Corrective Action(s): Please ensure arrival and departure times are recorded.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Upon inspection, staff could not produce the policies and procedures.
Corrective Action(s): Please ensure staff are familiar where the policies and procedures are kept for review.

Comments

At the inspection dated May 6, 2022 there were 3 children and 1 staff present. At this inspection the above noted contraventions were identified. The Licensee will provide Licensing with a written response. Licensing will review the response. As part of this Inspection a Facility Risk Assessment was completed and a copy was provided.

Licensing conducted a walk-through of the entire facility.

The following discussions were had with the Licensee:

· Staffing-Licensee is to be the primary caregiver
· Registrations & Emergency contacts
· Covid-19 prevention Strategies
· Physical Facility
· CRC's for those ordinarily present

A guest was staying at the facility with no valid criminal record check.Staff said that the guest had been living there for 1 week and will stay 1 more week for a total of 2 weeks.Licensing discussed that if the guest stays longer than 2 weeks then a Criminal record check must be completed.

The information contained in the report was discussed with the Staff and Licensing stated that the report will be emailed to the facility.
