Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standard of Practice (DOLSOP). All care categories were assessed for compliance.

Observed Violations
STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed 2 staff files; 1 staff's references were not in the file.
Corrective Action(s): The licensee said she will ensure that all documents are in the employee's file.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Licensing reviewed 2 staff files; 1 staff did not have their resume on file.
Corrective Action(s): Licensee will ensure that the file has all documents.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Licensing reviewed 2 staff files; both files did not have current validation.
Corrective Action(s): The licensee said she will ensure that the validation is corrected to reflect the current certificates the staff hold.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Licensing reviewed staff files and 1 staff did not have any documentation at the facility.
Corrective Action(s): The staff she just started last month, so her file is not here.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing observed that one of the fire extinguishers was expired since April 2023.
Corrective Action(s): Staff and licensee said it wasn't checked and they will ensure it is corrected.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing requested the attendance records and the staff was unable to produce the previous days attendance.
Corrective Action(s): The staff said they only have the day of attendance and the licensee has access to all of the others. The licensee said she'll ensure that they're printed and accessible on site.

At the inspection dated March 21, 2024, there were 5 children in care with 2 staff.
At the inspection, the above noted contraventions were identified.
Please provide Licensing with a written response, by the date noted below, stating how the identified contraventions will be addressed in order to ensure year round compliance.
As part of this Routine Inspection a Facility Risk Assessment Tool was completed. A copy of the report and the corresponding Risk Assessment was emailed to the Manager.
