Introduction

A scheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Two staff files were reviwed. One staff has an RCMP criminal record check and one staff has a criminal record check that is not site specific or has been obtained through the sharing program.
Corrective Action(s): The manager will ensure all staff have the required criminal record check.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: References were not available for two staff.
Corrective Action(s): The manger will ensure that a minimum of two references are verified for all staff.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Two staff files were reviewed. A resume was not available in either file.
Corrective Action(s): The manger will ensure a resume is available for all staff.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for two staff.
Corrective Action(s): The manager will ensure immunization status is available for all staff.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: There is no staff file available for the manager.
Corrective Action(s): A staff file needs to be available for the manager.

CARE AND/OR SUPERVISION: 14060 - CCLR s.39(1) - A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation (CORRECTED DURING INSPECTION): During this inspection a child was observed using the washroom without staff supervision.
Corrective Action(s): The manager stated that a staff person is always in the washroom with children and that she will ensure no children are unsupervised when using the washroom.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: On review of children's files one file did not have contact information for a doctor or medical clinic and one file did not have contact information for an emergency contact.
Corrective Action(s): The manager will obtain the required information.

RECORDS AND REPORTING: 19140 - CCLR s.57(2)(h)(i) - A licensee must keep, for each child, a record showing the following information: (h) any special instruction respecting the child's diet, medication, participation in a program of activities, or other matter relevant to the child's care, (i) given by the child's parent to the licensee in writing.
Observation: Two child with food allergies do not have a care plan and one care plan does not include the symptoms a child may have during an allergic reaction.
Corrective Action(s): The manger will ensure complete care plans are available for all children who have food allergies.

Comments

Summary of Inspection
At the inspection dated March 22, 2024 there were 11 children and two staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and written off site. A copy of this report will be emailed to the manager.
