Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officers observations, review of facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed:
Licensing, Physical Facility, Staffing, Policies and Procedures, Care & supervision, Hygiene and Communicable Disease Control, Medication, Nutrition and Food Services, Program, Records and Reporting.
As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year "historical" review of the facility's compliance and operation.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Lysol is being used to sanitize surfaces. The directions on the product state that the Lysol needs to be on the surface for 30 seconds to sanitize. Staff are not following these directions.
Corrective Action(s): Please make sure directions on all cleaning products are followed to make sure surfaces are sanitized.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Diaper creams in the Infant program and Toddler 1 are being stored in cubbies that are accessible to children. Licensing is concerned that children may ingest these creams.
Corrective Action(s): Please ensure that the diaper creams are not accessible to children.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A criminal record for 1 staff person is from another facility and was not applied for through the sharing program of the Criminal Records Review Agency.
Corrective Action(s): Please make sure all criminal record checks from other facilities are applied for through the sharing program of the Criminal Records Review Agency.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Resumes were not available for 2 staff.
Corrective Action(s): All staff need to have a resume on file at the facility.

STAFFING: 12151 - CCLR s.19(5)(a) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (a) a criminal record check for the person.
Observation: A volunteer was present during this inspection. The volunteer does not have a criminal record check.
Corrective Action(s): All volunteers must have a criminal record check at the facility.
Date to be Corrected: Before this person returns to the facility.

STAFFING: 12152 - CCLR s.19(5)(b) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (b) character references in respect of the person.
Observation: There are not references on file for the volunteer who was present during this inspection.
Corrective Action(s): References must be on file at the facility for all volunteers.
Date to be Corrected: Before the person returns to the facility.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: There was no record of fire drills available in the Infant program and Toddler 1. Staff stated drills had taken place.
Corrective Action(s): Please make sure a record of fire drill is available for all programs.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: There has been no Infant Toddler Educator in the Toddler 2 program since April 1, 2018. One staff who is working as an Early Childhood Assistant does not have certificate to prove they have the qualification. CCFL discussed ways that this contravention may be addressed with the manager.
Corrective Action(s): Please make sure that staffing meets the requirements of Schedule E CCLR at all times.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Time out is missing on several days in the month of May 2018 in the Infant program and Toddler 1.
Corrective Action(s): Please make sure time out is recorded every day for all children in all programs.
Date to be Corrected: Today and ongoing.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: 1 child does not have emergency contacts on file.
Corrective Action(s): All children need to have emergency contacts on file.

Comments

Licensing recommends that a copy of all staff qualifications and the facility licence is posted in the Infant program and Toddler 1 as these programs are located in portables away from the main facility building where the documents are currently posted.
Licensing reviewed what documents must be on file before a staff person or volunteer starts work at the facility with the manager.
Licensing recommends that the manager review the Child Care Licensing Regulation and ask the Licensing Officer if they have any questions or need clarification.
