Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act(CCALA) and the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the manager was not posted.
Corrective Action(s): Ensure the name of the manager is posted in a prominent place in the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following:
- Insufficient fall zone clearance around the outdoor equipment in the infant/toddler playground
- Insufficient fall zone clearance around a small slide in the infant classroom
- chipped walls in the toddler nap room, exposing the drywall
- Large storage bins stored on a 6ft shelf poses as a hazard in the event of an earthquake
Corrective Action(s): Ensure a healthy and safe environment is provided at all times.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A random selection of staff files were reviewed. Out of the 4 reviewed, 1 did not contain a criminal record check.
Corrective Action(s): Ensure a current and valid criminal record check is on file.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A random selection of staff files were reviewed. Out of the 4 reviewed, 1 file did not contain any references.
Corrective Action(s): Ensure a record of staff's references is on file.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: A random selection of staff files were reviewed. Out of the 4 reviewed, 1 file did not contain copies of any diplomas, certificates or other evidence of the person's training and skills.
Corrective Action(s): Ensure there is a record of staff's diplomas, certificates or training and skills.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: A random selection of staff files were reviewed. Out of the 4 reviewed, an immunization status was not obtained for one employee.
Corrective Action(s): Ensure a record of staff's immunization status is on file.

STAFFING: 12130 - CCLR s.19(3) - Without limiting subsection (2), if the duties of an employee include care for a child who requires extra support, a licensee must ensure that the employee has the training and experience and demonstrates the skills necessary to care for that child.
Observation: Licensing observed a support worker who is newly employed. In review of staff records and a conversation with the support staff, they do not have any training relevant to the care that is being provided to the child who requires extra support.
Corrective Action(s): Ensure staff who care for a child with extra support have the training and experience and demonstrates the skills necessary to care for that child.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing noted when children move between programs they are not signed out of one program and into another program.
Corrective Action(s): Ensure there is a record of children's arrival and departures within each program.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: In review of the children's records, Licensing noted a child requiring extra support. While there is some information in a careplan, it does not outline the courses of action in regards to the child's diagnoses.
Corrective Action(s): Ensure there is a care plan in place that is developed in consultation with the parent that includes diagnoses and actions recommended.

Comments

Summary of Inspection:
At the inspection dated November 2, 2022, there were 23 children in care with 7 staff.
At this inspection the above noted contraventions were identified.
Action required by the licensee includes providing a written response by November 9, 2022 .
Actions required by Licensing include reviewing the written response.

The following education was provided:
Covid-19 vaccine status for staff
Children requiring extra support
The toilets in the infant and toddler room bathrooms are overcrowded with items such as vacuums, brooms and garbage cans. There isn't sufficient space for children to use the toilet when they are toilet training.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy was provided to the facility along with this report. The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.
