Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: There was a broken teeter totter in the outdoor play area for Group Child Care (under 36 months), and the play equipment in the area was scattered with equipment fallen over; and paper beverage cups and lids were also in the area. Weeds are noted at front entrance areas and may be accessed by children.
Corrective Action(s): Please ensure daily checks are done of the outdoor play areas to ensure the health and safty of children and ensure equipment is safe and in good repair for children's use. The weeds were removed during the inspection

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Plastic bags are accessible to children stored in cupboard under sink in the washrooms and batteries are accessible in a drawer in Group Child Care (30 months to school age) program; and also plastic bags and personal bags were accessible in the space that is between the two rooms for the Group Child Care (under 36 months) programs.
Corrective Action(s): Please ensure hazardous products are not accessible to children at all times to ensure their health and safety.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: Staff indicated fire drills are conducted monthly and records were complete. An annual earthquake drill is also conducted, however an annual emergency drill which includes evacuation with all emergency supplies has not been conducted.
Corrective Action(s): Please ensure an annual emergency drill is conducted as per requirements.

CARE AND/OR SUPERVISION: 14270 - CCLR s.52(1)(b) - A licensee must ensure that a child, while under the care or supervision of the licensee, is not subjected to any of the following: (b) confinement or physical restraint by an employee, except as authorized in a child care's plan if the care plan includes instructions respecting behavioural guidance.
Observation: A child was observed sitting in a high chair in the Group Child Care (under 36 months) Program for approximately 20 minutes as staff were assisting children to settle for nap and this child did not nap at this time; a log book record also indicated a child was placed in a high chair as the child had bit a child while staff provided care to child who had been bit; and staff also confirmed use of high chair at other times to prevent child from disturbing children going to sleep.
Corrective Action(s): Please ensure staff use appropriate positive guidance in managing children's behavior and children are not restricted from activities if not napping.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation: A common cloth towel was in use in the Group Child Care (30 mos to school age) program washrooms for handwashing. Staff stated a common towel is used when they run out of single use cloth towels; in describing diapering procedures children's hands are not washed after diaper change.
Corrective Action(s): Please ensure a program of hygiene is promoted to ensure children's health and safety which includes single use towels at all times and washing of children's hands after diaper changes.

RECORDS AND REPORTING: 19030 - CCLR s.55(2)(a) - A licensee must notify the medical health officer within 24 hours after (a) a child is involved in, or may have been involved in, a reportable incident described in Schedule H while under the care or supervision of the licensee.
Observation: Log book record had a record of a medication error which required notification to the MHO and was not reported. The staff indicated she was not aware that this was a reportable incident.
Corrective Action(s): Please ensure staff are aware of the list of all reportable incidents as per Schedule H which are required to be reported within 24 hours to the MHO.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Seventeen children's registration files were reviewed and all were complete with the exception of missing the Dr.'s name and phone number for one child.
Corrective Action(s): Please review all records and ensure all are complete.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

At time of inspection there were 18 children in care in the Group Child Care (30 mos to school age) program with 3 staff including the Manager, and 3 staff with Group Child Care (under 36 mos) program. The staff ratios were in compliance. During nap time,the Manager did leave for a brief time, (less than 10 minutes) to support the other program across the street.
Daily schedule of activities is posted; monthly newsletter is provided to parents from September to June with programming information regarding themes and special events; parents of children in the Group child Care (under 36 mos) program are provided a daily report of child's day regarding naps, diaper changes, and food eaten.
Licensing observed the children engaged in free play, doing art, napping, and having snack. Staff indicated children are provided opportunity for daily outdoor play in the morning and afternoon except during the current heat wave children do not go outside in the afternoon.
Staff was observed interacting with the children and engaged with the children in their activities. Staff provided positive guidance and used respectful language.

Discussions with the Manager/Staff:-
- Manager indicated she has received information from Licensing regarding Bill 5 and the safety alert, and summer safety information.

- Discussion on active supervision and Manager will review practice at next staff meeting. Manager indicated staff were provided with copies of the information received from Licensing.
- Discussion Re: Lead in drinking water
- Discussion Re: RI reporting and notification to Duty Licensing Officer when facility Licensing Officer is not available.

A Licensing practicum student took part in the inspection.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
A follow up inspection may be conducted due to the number and nature of the contraventions.
