Introduction

All care categories were inspected during an unscheduled routine inspection to assess compliance w/:
• the Community Care & Assisted Living Act (CCALA)
• the Child Care Licensing Regulation (CCLR)
• relevant Director of Licensing Standards of Practices (DLSP)

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: An employee lacked her CRC, which the manager explained is unobtainable until the employee receives her BC Services Card.
Corrective Action(s): The manager must contact the Criminal Records Review Program to inquire about obtaining this employee's CRC immediately. All requirements of s. 19 are required by employees' 1st day of employment. This employee can't work alone w/ children or assist w/ diapering/toileting until she receives her CRC.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: The manager & an employee lacked their immunization status.
Corrective Action(s): The manager completed her immunization status form during the inspection.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation (CORRECTED DURING INSPECTION): There was no evidence that certificate validations had been completed for the manager & employees.
Corrective Action(s): The mananager validated her & her employees' certificates & printed a copy of each.

POLICIES AND PROCEDURES: 13010 - CCLR s.22(1)(a) - A licensee must (a) ensure that a community care facility has (i) emergency exits that meet the requirements of the BC Building Code, and (ii) a fire drill system that is approved as definedby section 31 of the Fire Services Act.
Observation (CORRECTED DURING INSPECTION): The fire extinguisher required its annual servicing in Jan/2022, according to the service tag.
Corrective Action(s): The manager purchased a new fire extinguisher.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation (CORRECTED DURING INSPECTION): *Repeat violation from FIR #CGEE-C3KS4H (01/Jun/2021)*
1/7 child lacked their MSP #.
Corrective Action(s): The manager communicated w/ this child's parent to obtain their MSP #.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation (CORRECTED DURING INSPECTION): 2/7 children's start dates only stated the month.
Corrective Action(s): The manager documented these 2 children's start dates.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation (CORRECTED DURING INSPECTION): *Repeat violation from FIR #CGEE-C3KS4H (01/Jun/2021)*
3/6 children were signed in today. In addition, each child has their own daily attendance sheet.
Corrective Action(s): The manager signed these 3 children in & created an attendance sheet that shows all 7 registered children together on 1 sheet.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation (CORRECTED DURING INSPECTION): 6/7 children lacked a photograph.
Corrective Action(s): The manager took individual, digital photographs of these 6 children.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation (CORRECTED DURING INSPECTION): The manager only had 1 reference.
Corrective Action(s): The manager printed a copy of her 2 other references.

Summary of FIR #CGEE-CDAR95 (06/Apr/2022)

9 violations were observed today, in which 7 violations were corrected today & corrective action for the remaining 2 violations includes obtaining employee documentation.

CCFL discussed key points from the BCCDC's "Public Health Guidance for Child Care Settings" (http://www.bccdc.ca/Health-Info-Site/Documents/COVID_public_guidance/Guidance_Child_Care.pdf).

CCFL reviewed the inspection w/ the manager; however, this report & the facility risk assessment were completed @ the Burnaby Health Protection office & emailed to the manager on 08/Apr/2022.
