Introduction

All areas of the community care facility were inspected for compliance during a routine inspection to assess compliance w/ the:
• Community Care & Assisted Living Act (CCALA)
• Child Care Licensing Regulation (CCLR)
• relevant Director of Licensing Standards of Practice (DLSP)

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12160 - CCLR s.20(1) - The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation: An ordinarily present individual requires a BC Ministry of Justice Criminal Records Review Program criminal record check (CRC).
Corrective Action(s): Please apply for a CRC for this individual.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: * REPEAT VIOLATION FROM FIR #CGEE-BDANM5 (19/JUN/2020) *

1 child lacked her start date.
Corrective Action(s): All requirements of s. 57(2) must be obtained by children's 1st day of care.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: * REPEAT VIOLATION FROM FIR #CGEE-BDANM5 (19/JUN/2019) *

The licensee documents present children's attendance on her mobile phone. CCFL discussed the requirement for children's records (this includes attendance) to be available for 2 years, which could be lost from a mobile device.
Corrective Action(s): Please ensure that ALL registered children's daily attendance is recorded (absentees must be documented) & files from 2 years prior are easily obtainable.

RECORDS AND REPORTING: 19180 - CCLR s.57(2)(k) - A licensee must keep, for each child, a record showing the following information: (k) the date on which the child stops attending the community care facility.
Observation: 1 child's end date wasn't documented.
Corrective Action(s): Children's last day of care must be documented.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: * REPEAT VIOLATION FROM FIR #CGEE-BDANM5 (19/JUN/2019) *

The licensee stated that a child no longer requires her care plan; however, this was not documented in her file.
Corrective Action(s): The child's care plan must be updated annually w/ her parent to capture the most current information.

Summary of FIR #CGEE-BQ3M8R (28/May/2020)

5 violations were observed today in which corrective action includes obtaining:
• children documentation
• a CRC for an ordinarily present individual

Licensees & employees play a key role in protecting children from, & minimizing the impact of infection & illness. FHA discussed hand washing, cleaning, & physical distancing as per the BC Centre for Disease Control & the BC Ministry of Health's "COVID-19 Public Health Guidance for Child Care Settings" (https://www2.gov.bc.ca//assets/gov/health/about-bc-s-health-care-system/office-of-the-provincial-health-officer/covid-19/covid-19-pho-guidance-childcare.pdf).

The inspection was reviewed w/ the licensee; however, this report & the Facility Risk Assessment Tool were written @ the Burnaby Health Protection office on 29/May/2020.
