Introduction

An unscheduled Routine Inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP).

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation (CORRECTED DURING INSPECTION): One electrical outlet were uncovered and accessible where children play. This was corrected by staff during the inspection.
Corrective Action(s): Please ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Three staff files were reviewed, one staff file was not site specific.
Corrective Action(s): Please ensure to obtain a criminal record check that is site specific.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Three staff files were reviewed. One staff file contained only partial immunization record.
Corrective Action(s): Please ensure to obtain evidence that the person has complied with the province's immunization and tuberculosis control program.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Licensing reviewed three staff files. Two staff files contained expired validation of Early Childhood Education Certification.
Corrective Action(s): Please ensure not to employ a person in a community care facility as an educator or assistant unless the person who holds a certificate issued has been verified by the system maintained by the early childhood registry.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: Licensing reviewed the emergency evacuation plans. There was no record of having practiced the emergency plan. Staff said they had completed the practice, however the documentation was at the head office.
Corrective Action(s): Please ensure that each employee practices implementing the emergency plan at least once each year.

Comments

Summary of Inspection:
During today’s inspection, there were no children, 2 staff and one staff on site. The facility had no children in care, however the staff chose to go ahead with the inspection on this day.
At this inspection the above noted contraventions were identified. Licensee is required to submit a corrective action plan to address the contraventions.

The following was discussed:
During inspection licensing reviewed the process for development of a care plan with the staff. Staff showed licensing a care plan that was currently under development, and one other that was complete.
Discussed documentation in daily outdoor log to document regular outdoor checks are completed.
Licensing reviewed and discussed the emergency evacuation response supplies with the staff. Staff said there was storage located in the classroom and storage of food and water in a shed with the schools supplies as well.
