Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practise (DLSP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The facility licence and name of Manager are not displayed in a prominent place in the facility.
Corrective Action(s): Please ensure that the facility licence and name of Manager is displayed in a prominent place in the facility.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: The Licensee's Early Childhood Educator licence to practise is not displayed in a prominent place.
Corrective Action(s): Please ensure to display any certificate of an ECE or ECE Assistant in a prominent place in the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: -There is a gate at the top of the stairs that lead down to the front door. As discussed at the last inspection, the door knob of the gate was to be made child proof. This has not been done yet.
- The diaper change area is a piece of plywood with a plastic cover on top that is not secure. This makes it difficult to sanitize when wiping as the cloth gathers and does not remain smooth
Corrective Action(s): Please ensure that the door knob is child proof to prevent children from opening the gate to the stairs.
Please ensure that the diaper change area is comfortable for children and the surface is easily wipable.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The following was observed outside:
-a highchair is in the backyard that is dirty and not acceptable to use for children
-one part of the railing fence that is on the upper deck moves slightly when pushed back and forth
The following was observed inside:
-the couch in the main play room has a large tear in the seat cushion allowing the stuffing to come through
Corrective Action(s): Please ensure facility is in good repair. A safety plan is to be submitted regarding the loose railing on the deck. The children access the deck to go down the stairs to the backyard. Please provide a detailed plan how this area will not be accessed by children until the railing can be repaired or replaced. Please include an alternate way that children will access the backyard.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: The following was observed inside the facility:
-blind cords accessible to children
-various items in the bathroom accessible to children such as sanitizing wipes, shaving cream, toilet cleaner, air freshener spray, plastic bags
The following was observed outside the facility:
-clothes line that is right at children's head level
-miscellaneous items that appear to need to be disposed of
-scattered garbage
Corrective Action(s): Please ensure that children do not have access to hazardous items.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: Fire Drill practise is not documented for the months of June 2021 and July 2021.
Corrective Action(s): Please ensure fire drills are practised at least once a month and documented to show they have been done.

RECORDS AND REPORTING: 19060 - CCLR s.57(1)(a)(b)(c) - A licensee must keep current records for each child showing (a) the information set out in subsection (2), (b) if applicable, the information and agreements set out in subsections (2.1) and (2.2), and (c) the consents referred to in subsection (3).
Observation: One child was in attendance who did not have a file on site. No information was available for the child other than the parent's names and phone numbers as there was a sibling in attendance.
Corrective Action(s): All children who attend the facility must have a complete file on site.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: 5 children's files were reviewed and one is missing immunization status.
Corrective Action(s): Please ensure immunization status is available for all children who attend the facility.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Attendance was not taken for August 5 and 6, 2021.
Corrective Action(s): Please ensure that attendance is taken every day noting arrival and departure times for each child that attends.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: 5 children's files were reviewed and 4 are missing a photograph or digital image.
Corrective Action(s): Please ensure there is a photograph or digital image of the child available at all times.

Comments

At the inspection dated August 6, 2021, there were 5 children and 1 staff present. At this inspection, the above contraventions were identified. As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided.

Please note that the Licensee's ECE licence to practise expires November 12, 2021. Please ensure that sufficient time is taken to apply for renewal so that a new licence is issued before the current one expires.

A discussion was had with the Licensee regarding the following:

-maintaining systems and checklists to ensure that compliance is met by the Licensee
-repeat violations that are noted in inspection reports
-appropriate use of a highchair
-providing more toys in the outdoor play area
