Introduction

An announced routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance with a focus on health and hygiene practices during the COVID-19 pandemic.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following: (Repeat contravention)
-Baseboard throughout the facility were in need of some repair and maintenance.
-The pony wall in the toddler room had chipping paint.
-Chipping paint through out the facility.
-A broken kitchen faucet in the three to five program.
-A damaged cupboard door.
Corrective Action(s): Ensure the facility is in good repair at all times.
Date to be Corrected: August-13-20.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Upon an inspection of 3 staff files, it was noted that one of the staff members did not have a criminal record check from the criminal record review program.This is a repeat contravention.
Corrective Action(s): Ensure site specific criminal record checks are in place before the start of employment.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Upon an inspection of three staff files, it was noted that one 2 staff files were missing evidence of immunization declaration. This is a repeat contravention.
Corrective Action(s): Ensure staff files are complete.

CARE AND/OR SUPERVISION: 14060 - CCLR s.39(1) - A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.
Observation (CORRECTED DURING INSPECTION): Upon licensing's arrival, there were three children napping in the program identified as "Infant Room" while the room staff were physically in the program identified as "toddler room".
Corrective Action(s): Ensure that supervision is maintained at all times by a staff.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Licensing inspected records of 9 children noting that 3 records were missing a date of enrollment.
Corrective Action(s): Ensure children's files are complete.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: 9 children's records were inspected and one was missing a medical practitioner's phone number.
Corrective Action(s): Ensure children's records are complete.

Comments

Summary of Inspection:
At the inspection dated July-30-20, there were 17 children in care with 7 staff members including the Manager.
A COVID-19 Risk Screening was conducted before the inspection.
At the inspection, the above noted contraventions were identified.
Please provide Licensing with a written response, by the date noted below, stating how the identified contraventions will be addressed in order to ensure year round compliance. The intent of a written response is for the Licensee to demonstrate that systems will be/are established to self identify and maintain compliance at all times.
As part of this Routine Inspection a Facility Risk Assessment Tool was completed.
This report was written off site due to COVID-19 safety practices. The contraventions and summary items identified in the report were reviewed with the Manager before Licensing's departure.
A copy of the report and the corresponding Risk Assessment was emailed to the Manager.
The following items were discussed:
-Planned emergency response during COVID-19.
-Communicable disease prevention practices.
-Health/hygiene/sanitizing practices during COVID-19 which included review of cleaning and sanitizing as multiple steps and review of proper diapering practices.
-Storage of sleep equipment and bed linens conducive to proper health and hygiene practices.
-Reusable hand towels to be one time use only during COVID-19.
-Required development of COVID-19 safety plans for staff and children.
-Modifications to facility's medication consent form discussed in order to reflect the duration medication is required to be administered.
-Legislative requirement of children having access to staff member with a valid first aid certification.
-Discussion was had in regards to finding ways to cool the ground surface in the infant/toddler outdoor play space. Some suggestions were offered by Licensing. Licensing reiterated active play requirements for children in care.
