Introduction

An unannounced follow-up inspection was completed today. The inspection is in response to contraventions identified at the routine inspection #CLAN-CKZSJT.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection the following was observed inside the facility:
-a crib mattress had rips in it. This was not corrected by the date specified on the routine inspection. This is a repeat contravention
-Four small facecloths were observed on the counter. It is uncertain which child uses which cloth to dry their hands. In discussion with the staff she stated the children use the towels to dry their hands. Multiple children using multiple towels to dry their hands may cause cross contamination.
During the inspection the following was observed in the outdoor play area of the facility:
-Stairs leading to the back porch do not have a gate at the bottom of the stairs to prevent access. This was not corrected by the date specified on the routine inspection. -Tricycles were observed in the outdoor play area. A drop off was observed. Please place a barrier to prevent access and provide active supervision at all times where tricycles are used. This was not corrected by the date specified on the routine inspection. This is a repeat contravention.
-An umbrella stand was behind the shed. This is a heavy metal structure. This was not corrected by the date specified on the routine inspection. This is a repeat contravention from inspections: #CLAN-CKZSJT, #CLAN-CBYSYK, #CLAN-C9VQEX, #CLAN-BURQAF, #CLAN-BBZUZN

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed several puncture marks in the plastic flooring. This could potentially harbour bacteria. This was not corrected by the date specified on the routine inspection. PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following during the inspection:
-A bottle of bleach was located under the sink. A lock was observed but was not applied to the centre cupboard. The cupboard was easily opened. Inside were four bottles of toilet bowl cleaner, laundry detergent and 3 large bottles of bleach without a safety cap. This was easily accessible and at the children's level. This could cause a potentially serious hazard. This was corrected during the inspection. This was not corrected by the date specified on the routine inspection. -A plunger was located in the outdoor play area. This could cause a potential health hazard.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: One staff record and one Manager record were reviewed. One staff record was missing a criminal record check. This is a repeat contravention from inspection #CLAN-CKZSJT.
Corrective Action(s): Please ensure staff records are complete.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained for the Manager. Another staff's resume was in the Manager's record. STAFFING: 12151 - CCLR s.19(5)(a) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (a) a criminal record check for the person.
Observation: A criminal record check (CRC) was not obtained for one volunteer.
Corrective Action(s): Please ensure CRC's are obtained for all volunteers at the facility.

STAFFING: 12152 - CCLR s.19(5)(b) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (b) character references in respect of the person.
Observation: A minimum of two character references were not obtained for one volunteer.
Corrective Action(s): Please ensure references are obtained for volunteers prior to volunteering at the facility.

STAFFING: 12153 - CCLR s.19(5)(c) - Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (c) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one volunteer.
Corrective Action(s): Please ensure immunization status is obtained for volunteers prior to volunteering at the facility.

PROGRAM: 18060 - CCLR s.44(3)(4)(5) - A licensee, other than a licensee providing a care program described as Occasional Child Care, must provide each child with daily outdoor play periods unless weather conditions would make it unreasonable to do so. (4) Despite subsection (1), a licensee who provides a care program described as Occasional Child Care need not provide a program of outdoor activities. (5) Despite subsection (3), that subsection applies to a licensee who provides a care program described as Child-minding only if the program provides care for 3.5 hours or more each day.
Observation: During the inspection Licensing asked the staff if the children go outside to play each day. The staff stated that they don't play outside if it is raining as the children do not have the outdoor clothing needed to play outdoors. This is a repeat contravention from inspection #CLAN-C9XTS8
Corrective Action(s): Please ensure children have access to outdoor play on a daily basis to comply with the legislation.

Comments

At the inspection dated January 11, 2023 there were 4 children, one staff and a volunteer were present. At this inspection the above noted repeat contraventions were identified. Please correct the above noted contraventions by January 18, 2023 , unless otherwise specified in the report. Please submit a written response to Licensing by January 18, 2023 stating how you have corrected the above noted contraventions.
