Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP).
Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy is provided to the facility.
The Risk Assessment includes any non-compliance identified during the routine inspection and a 3 year ‘historical’ review of the facility’s compliance and operation and is used to determine inspection frequency.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: *Licensing observed an electrical fan plugged into the wall in the Infant program. This fan had a cord that was exposed and is considered a tripping hazard to the children.
*Licensing also observed a spray bottle in the Infant program that was not labelled. Supervisor stated this was a new bottle and contained the bleach and water solution.
Corrective Action(s): Please ensure the cord is inaccessible to children to prevent any tripping
Please ensure all bottles containing bleach and water solution are clearly labelled.(this was corrected during inspection)

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing observed that the fire drills for the group child care under 36 month program had not been recorded since March 2017.
Corrective Action(s): Please ensure all drills practiced are clearly recorded as per Section 22 or the CCLR's.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation (CORRECTED DURING INSPECTION): On arrival the Group Child Care under 36 months had 9 children in their Infant room which is licensed for a capacity of 8. This is a repeat contravention. A discussion took place with the Manager in regard to when over 8 children, the group must move into the larger Toddler room which is licensed for 12 or split the group into the 2 programs dependant on staffing. The group did split as soon as the 3rd staff arrived.
Corrective Action(s): Please ensure that capacity is not exceeded in any of the program rooms.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation (CORRECTED DURING INSPECTION): On arrival in the group child care under 36 months program, Licensing observed that there were 9 children and only 2 staff. Supervisor stated that 2 staff had called in sick today and they were waiting for a replacement staff. They were expecting 12 children to attend today. The Manager arrived a short time later. This is a repeat contravention.
Corrective Action(s): Please ensure that staffing meets ratio requirements at all times.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: On a review of a random selection of children's files, Licensing observed that 2 were missing the sex of the child and 1 was missing an immunization status.
Corrective Action(s): Please ensure all children's records are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing observed in the group child care under 36 month program that the attendance records for today showed 9 children signed in but actually 10 children in attendance at 9.45am.
Corrective Action(s): Please ensure an accurate attendance process is in place in case of an emergency situation in which evacuation is required.

Comments

The operation of the facility is in compliance with current regulations of the Community Care and Assisted Living Act (CCALA) and the Child Care Licensing Regulation (CCLR) apart from any listed above

On site today was The Manager and 5 other staff by 10 am with 26 children.
Staff to child ratio was in compliance with regulations in the Group Child Care 30 months to school age program.
A staffing exemption is in place for a Responsible Adult to cover staff break times at the facility
Programming is posted and available for parent review and children's work is displayed in the facility.
Licensing observed Staff engaged with children during snack time and outdoor play time. Staff used appropriate language and guidance techniques when working with the children.
Licensing observed the children having snack time and discussed healthy eating habits with one staff member for a child observed to be eating unhealthy food.

Discussions with the Manager/Staff:-
- Licensing reviewed staffing placements with the Manager and recommends utilizing their other program staff to meet regulations.
- Licensing provided information regarding care plans which may be required for any child with nutritional concerns.
- Licensing recommends placing staff's posted certificates in each program for parental view.
- Licensing also recommends an audit of staff files to ensure complete and up to date information is in place.

A response in writing is required to be submitted to Licensing by the date below, outlining how the contravention(s) have been addressed.
