Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 3 staff files were reviewed; 1 staff's CRC is not obtained.
Corrective Action(s): Ensure all staff files are complete.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: 3 staff files were reviewed, 1 staff's references were missing.
Corrective Action(s): Ensure all staff files are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: 3 staff files were reviewed; 1 staff's immunization records were missing.
Corrective Action(s): Ensure all staff files are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: 3 staff files were reviewed; 1 staff's certificate (ECEA) was not validated by the ECE registry.
Corrective Action(s): Ensure that staff files are complete.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Fire drill records were not maintained for the month of May, June, July and August. No records for yearly emergency drill for 2021.
Corrective Action(s): Ensure that monthly fire drills and yearly emergency drill are practiced with the children and staff and recorded accordingly.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: Group Child Care - Staff to Child ratio not maintained. (ECE/ASST/ASST).
Corrective Action(s): Ensure staff to child ratio is maintained as per Sch.E of the CCLR.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: 10 children files were reviewed; 1 child's immunization records were missing.
Corrective Action(s): Ensure all children files are complete.

RECORDS AND REPORTING: 19220 - CCLR s.58(1)(b) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (b) the courses of action recommended by health care professionals to address the needs of the child requiring extra support.
Observation: A care plan does not include the course of action recommended by health care professionals for a child requiring additional support.
Corrective Action(s): Ensure care plans ( with sufficient information) are in place for children requiring extra support.

Comments

Summary of Inspection
On the inspection date of September 14, 2022 there were 9 children and 2 staff present. At this inspection the above noted contraventions were identified. Licensee is required to provide a written response by below date, including how areas found to be in non-compliance are addressed. The contravention noted in this report were reviewed with the manager during today's inspection. As part of this Routine Inspection a Facility Risk Assessment was completed and copy was provided.
The following education/recommendations were provided:
-Care Plans
-Covid 19 vaccination records
-Transportation policy/ communication with parents
-Emergency supplies
-Minor incident book: to keep a log for all minor incidents incl. minor accidents/illness/unexpected events not requiring medical attention and not listed on Schedule H of the CCLR
