Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were reviewed for compliance with the exception of the preschool playground due to weather conditions and the school age program as the children were not in attendance during this time.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection the following was observed inside the facility:
-a supply cupboard was open that contained plastic bags and a chemical to reduce odors. This could cause a potential choking hazard and a poisoning hazard.
-a tv was not anchored to the wall. This could cause a potential falling hazard. In discussion with the staff she stated a mounting bracket has been ordered for the tv. This will be installed when it arrives.

In addition it was noted that the bottle being used for disinfection was not being changed on a daily basis.

Corrective Action(s): Please ensure a health and safe environment is being provided to children at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the sinks in the washrooms. In one wasroom the caulking is cracking and there are noticible gaps between the wall and the sink.
Corrective Action(s): Please ensure the furniture equipment and fixtures are in good replair while children are in attendance.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: During the inspection it was observed that the annual emergency drill waas not recorded. In discussion with the Supervisor she stated that the drill is completed annually but it is not recorded. This is a repeat contravention from inspection # SMOY-A7EQGJ
Corrective Action(s): Please ensure the date of the annual evacuation plan is recorded when it is completed.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: During the inspection 12 children's files out of 60 were reviewed. Two children's start dates reflected that they started the preschool in the year before turning 3 years old. Within section 2 (c) (ii) of the Child Care Licensing Regulation (CCLR) it states that a program that provides care to preschool children are at least 36 months old by December 31st of the year of entrance. This was corrected at the inspection.
Corrective Action(s): Please ensure when children start the preschool that their birthdate is in compliance with the legislation to ensure they are divided into groups as outlined in Schedule E.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Licensing reviewed attendance records for the month of February. Three departures times were missing.
Corrective Action(s): Please ensure the attendance records indicating arrival and departure times for each child are complete.

RECORDS AND REPORTING: 19140 - CCLR s.57(2)(h)(i) - A licensee must keep, for each child, a record showing the following information: (h) any special instruction respecting the child's diet, medication, participation in a program of activities, or other matter relevant to the child's care, (i) given by the child's parent to the licensee in writing.
Observation: Licensing observed one form respecting special instruction regarding a child's medication was missing from the child's file
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Licensing observed records for the staff records. A staff qualification documentation was noted for the school age staff. No staff records or qualification documentation record was present for the preschool staff, although staff certificates and first aid certificates are present and posted in the facility.
Corrective Action(s): Please ensure staff records are kept in a single location at the facility or a staff qualification documentation chart is completed in the absence of staff records.

Comments

At the inspection dated February 14, 2019 there were 18 children and 4 staff present. At this inspection the above noted contraventions were identified. Please ensure a written response addressing the above noted contraventions is submitted to licensing by February 28, 2019. A follow up inspection will need to be completed to ensure the staff qualifications are reviewed. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
