Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were reviewed for compliance.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation (CORRECTED DURING INSPECTION): During inspection hot water that was accessible to children was 56C

During inspection staff turned off the hot water to this tap.
Staff stated children are supervised at all times when using water at this sink.

This violation was previously noted on Facility inspection report #KSEY-B8FPJ7 (Jan 15/19) and had been corrected by the Licensee at that time.
Corrective Action(s): Ensure hot water temperature at faucets accessible to children remains at, or below, 49C. Staff to monitor the hot water temperature and address the issue immediately should the temperature go above 49C.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: During inspection Licensing reviewed staff files and noted that there is no proof on file that one staff person's new ECE certification has been verified.
Corrective Action(s): Ensure ECE certificate is verified for this staff person.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: During inspection Licensing reviewed staff files and noted one staff person's Criminal Record approval letter is addressed to a different employer.
Corrective Action(s): Ensure staff person's Criminal Record approval letter is addressed to the Licensee.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: During inspection Licensing staff stated that they did not record their annual emergency evacuation drill.
Corrective Action(s): Ensure emergency drills are recorded as proof that they have been conducted.

Comments

At the inspection dated Dec 5, 2019 there were 5 children and 2 staff present. At this inspection the above noted contraventions were identified.
Licensee to submit documentation to Licensing when violations have been addressed.
As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
During inspection Licensing did not observe a service tag on the fire extinguisher. Licensing was unable to determine if the fire extinguisher had been purchased in the past year.
Licensee to ensure fire extinguisher is serviced annually.

During inspection Licensing reviewed the contents of the emergency evacuation kit with staff. Licensee reminds staff that they would need 72 hours worth of diapers/ wipes, formula (if any child is bottle fed) etc in their kit as well.

During inspection Licensing observed:
- children interacting with staff during two circles with circles and songs, engaged in free play in the inside and outside areas.
- staff interacting with children while they were engaged in activities, giving warnings before times of transition and assisting with problem solving when necessary.
