Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following:
- Four plastic blinds on one side of the shed accessible to children in care.
- Two medium sized wood pieces on one side of the shed accessible to children in care.
- Children's blankets for nap time are stored together on the hallway shelf. Education provided on cross contamination and spreading of germs.

Corrective Action(s): Please ensure that a healthy and safe environment is provided at all times while children are in care.
Date to be Corrected: February 14, 2020.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following;
- One shelf with buckets of toys on it, in the main play area, that is wobbly upon touch.
- A hole in the wall behind the nap room door.
Corrective Action(s): Please ensure that the furniture, equipment and fixtures within the care facility are clean and in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed the following that are accessible to children;
- Two knives in an unlocked kitchen drawer.
- One adult scissor in an unlocked kitchen drawer.
Corrective Action(s): Please ensure that children do not have access to any object or substance that may be hazardous to the health and safety of a child.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Upon a review of two staff files Licensing observed one staff's record missing character references.
Education provided on the importance of having character references and complete staff records.
Corrective Action(s): Please ensure that staff records are complete prior to the staff working at the care facility.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Upon a review of two staff records Licensing observed one staff's record missing a resume.
Education provided on the importance of having a resume and complete staff records.
Corrective Action(s): Please ensure that staff records are complete prior to the staff working at the care facility.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Upon a review of two staff records Licensing observed one staff's record missing immunization status.
Corrective Action(s): Please ensure that staff records are complete prior to the staff working at the care facility.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: Licensing observed that a fire drill has not been practiced since August 2019.
Licensing provided education on the intent of the legislation and practicing fire drills at least once a month.
Corrective Action(s): Please ensure that each employee practices implementing the fire drill system at least once each month.
Date to be Corrected: February 12, 2020.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: Licensing observed that an emergency drill was not practiced once last year.
Education provided on the important of practicing an emergency drill once a year.
Corrective Action(s): Please ensure that each employee practices implementing the emergency plan at least once each year.
Date to be Corrected: February 28, 2020.

STAFFING: 12210 - CCLR s.23(1)(a) - A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.
Observation: Licensing observed that there is one staff that is alone with the children for some time that does not hold a valid first aid and CPR certificate that meets the requirement of Schedule C.
Education provided.
Corrective Action(s): Please ensure that children have at all times immediate access to an employee who holds a valid first aid and CPR certificate provided on completion of a course that meets the requirement of Schedule C.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Upon a review of two staff records Licensing observed that one staff's criminal record check is addressed to another facility and not site specific.
Education provided on sharing forms.
Corrective Action(s): Please ensure that current staff records are maintained.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Upon a review of six children records Licensing observed two children's records missing immunization status.
Corrective Action(s): Please ensure that children's records are complete prior to attending the care facility.
Date to be Corrected: February 18, 2020.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Upon a review of six children's records Licensing observed two children's records missing the name and telephone number of a medical practitioner.
Licensing provided education on what would meet the intent of this regulation.
Corrective Action(s): Please ensure that children records are complete prior to attending the care facility.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Upon a review of six children's records Licensing observed two children missing a photograph or digital image
Corrective Action(s): Please ensure that children records are complete prior to attending the care facility.

Comments

Summary of Inspection
At the routine inspection conducted today, February 12, 2020, there were 2 children and the Licensee present. At this inspection the above noted contraventions were identified. The Licensee is required to correct all identified non-compliances by the dates indicated above in the violations section. A written response is to be provided to Licensing on the date specified for Licensing to review that appropriate corrective action has been taken to address all identified non-compliances. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:

Cleaning of indoor and outdoor toys and equipment
Attendance records
Sanitization
DIN # products.
Emergency bag/supplies
Care plans
Supervision
Licensing informed the Licensee that when reporting any reportable incidents to get in direct contact with a Licensing officer. If the Licensee's Licensing officer is unavailable then to call the Duty Line at (604) 587-3936.
