Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Manager name is not posted in a prominent place in the facility.
Corrective Action(s): Ensure that the manger's name is posted in the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: A bag used for storing the medication was placed on the counter which was easily accessible to children. The bedding is stored on the cots in the nap room. The bedding in the infant nap room is left on the mats, stacked on top of each other.
Corrective Action(s): Ensure that the medication or the storage bag is inaccessible to children. Ensure that the bedding used for children are stored separately and not on top of the cots.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Criminal record check has not be obtained and is not included in the staff file.
Corrective Action(s): Ensure that a system is developed to obtain the CRC clearance before the employment and is included in the staff file.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A minimum of two character references was not obtained for two employees.
Corrective Action(s): Ensure that references are obtained before the employment starts and are included in the staff file.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of person's work history was not obtained or included in the employee's file.
Corrective Action(s): Ensure that a resume is obtained and included in the employee file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Certificate validation was not obtained and included in the employee's file.
Corrective Action(s): Ensure that the certificate must be verified by the system maintained by the early childhood registry and included in the employee's file.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Emergency supplies have some food items that are expired and manager informed licensing that they are in the process of asking families to replenish the supplies.
Corrective Action(s): Ensure that system is in place to replenish the supplies before they expire.

MEDICATION: 16020 - CCLR s.53(1)(b) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (b) readily accessible to employees.
Observation: Expired medication is stored on site. Over the counter medication did not have the correct dose and time details included on the consent form.
Corrective Action(s): Ensure that expired medication is returned or discarded and the consent forms are completed in full to prevent risk of medication error.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Of 8 files reviewed 2 files did not include the date of enrollment in the community care facility.
Corrective Action(s): Ensure to keep for each child a record showing the date of enrolment in the community care facility.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: It was noted that the children's photos were either missing or had not been updated on the emergency cards or children's files.
Corrective Action(s): Ensure that a system is developed which contains means of identifying children including photograph or digital image of the child.

Comments

Summary of Inspection:
At the inspection dated June 06, 2022 there were 58 children and 10 staff present including the assistant manager. Manager was not present on the site. Licensing was informed that the manager is on leave and the assistant manger has stepped in the role of the manager. At this inspection the above noted contraventions were identified. Licensee is required to submit a corrective action plan to address the contraventions.

The following was discussed:
Informing licensing when there is any change at the facility i.e change of manager.
Medication administration procedure was discussed.
