Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: 2 educator or assistant certificates were not posted
Corrective Action(s): Ensure that all educator or assistant certificates are posted.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 2 criminal record checks were not current or addressed to the facility.
Corrective Action(s): Ensure that each person employed has a criminal record check addressed to the facility.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation (CORRECTED DURING INSPECTION): 2 educator or assistant certificates were not verified. The Manager verified them during the inspection.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The Manager stated they completed an emergency drill but did not record it.
Corrective Action(s): Ensure that each emergency drill is recorded.

Comments

Summary of Inspection
At the inspection dated November 2, 2022 there were 50 children and 10 staff present. At this inspection the above noted contraventions were identified. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The following education/recommendations were provided:
· Promoting Active Play in the program
· Tracking movement of children between classrooms
· Storing care plan with emergency medication in backpacks
· Active Supervision
· Lead in the Water
