Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: There are numerous walls throughout the facility that appear dirty and where the paint is chipping and the drywall is exposed.
Corrective Action(s): Ensure the facility is clean and in good repair at all times.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Licensing reviewed four staff files. One of these files did not include evidence that the staff members Early Childhood Educator certificate had been verified through the Early Childhood Educator Registry.
Corrective Action(s): Ensure all staff files are complete.

MEDICATION: 16020 - CCLR s.53(1)(b) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (b) readily accessible to employees.
Observation: Medication was not readily accessible to employees.
Corrective Action(s): Ensure medication is accessible as per a child's care plan.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Licensing reviewed five children's files. One of these files did not include the child's enrollment date.
Corrective Action(s): Ensure all children's files are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: At today's inspection the attendance records did not accurately reflect which children were in attendance in each service type. The Manager explained that the facility regularly moves children between the two service types at this facility and therefore the sign in sheets are not always accurate.
Corrective Action(s): Ensure the attendance records accurately reflect which children are in care in each program.

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: No care plans available for one or more children requiring extra support.
Corrective Action(s): Ensure all children requiring extra support have a care plan in place.

Comments

At this inspection dated April 6, 2022 there were 16 children, 3 staff, and the Manager present. At this inspection the above noted contraventions were identified. The facility is required to take corrective action to bring the facility into compliance and provide a written response to Licensing by April 15, 2022. As part of this routine inspection a facility risk assessment tool was completed and a copy will be provided.

The inspection findings were reviewed with the Manager at the time of the inspection. The inspection report and facility risk assessment tool were written off site and a copy of this report and the risk assessment will be provided to the facility.
