Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed some bed mats in the nap room touching each other. A potty that had urine in it was in the hallway. The manager removed the potty during this inspection.
Corrective Action(s): To mitigate the risk of the spread of infection please ensure bed mats and bedding are not touching each other at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: The following were observed during this inspection:
-Excessive amounts of dust on a heating vent.
-Cobwebs in the bathroom door frame.
-Paint peeling off the bathroom ceiling.
-A heating vent not securely attached to the wall.
-Rips in the cover of the change pad.
-Peeling drywall in a hallway.
-Walls throughout the facility in need of cleaning.

Corrective Action(s): All areas of the facility must be clean and must not need to be repaired.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): Vitamins and a container of essential oils were accessible to children on a shelf behind the high chairs. These items were removed during the inspection. Hazardous items being accessible to children is ongoing repeat noncompliance.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Although the manager and family member were aware that their criminal record checks had expired in March 2022, they have not applied for renewals. The family member stated this was because they did not have the required access code and had not contacted Licensing to obtain this.
Corrective Action(s): A current criminal record check must be available for all persons living at the address.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: There are not enough supplies in the emergency kit to last 72 hours for seven children. Water in the kit was being stored in a soda bottle and a large plastic honey container. This is repeat noncompliance and was noted on routine inspection #WBET-C9NQFF and follow up inspection #WBET-CBWRRR. Licensing discussed what should be included in the emergency kit and also that the kit needs to be in a container that is easy to transport in the case of an emergency. The first aid kit does not contain enough supplies to deal with minor first aid incidents.
Corrective Action(s): An emergency kit with supplies for 72 hours and a fully stocked first aid kit must be maintained. Water in the kit must be in the original container.

NUTRITION AND FOOD SERVICES: 17010 - CCLR s.48(1)(a) - A licensee must (a) ensure that each child has healthy food and drink according to the Canada's Food Guide.
Observation: Perishable items such as meat and fish that were in children's lunch boxes, were not stored in the fridge.
Corrective Action(s): All perishable food items must be stored between 0-4c to ensure the food does not spoil.

RECORDS AND REPORTING: 19051 - CCLR s.56.1(2)(a) - A licensee must keep (a) a copy of the written statement, referred to in section 19 of the Act, that the licensee delivers to persons who prepay part of the cost of services
Observation: Files for 10 children were reviewed. A parent contract was not available in two files.
Corrective Action(s): A parent contract needs to be available for all children.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Files for 10 children were reviewed. A medical insurance plan number was not available for one child.
Corrective Action(s): Please ensure a medical insurance plan number is available for all children. This may be a BC Medical plan number or a private medical insurance number.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: The manager stated that absences are not being recorded.
Corrective Action(s): A record must be kept of every time a child is absent.
Date to be Corrected: Today and ongoing.

RECORDS AND REPORTING: 19180 - CCLR s.57(2)(k) - A licensee must keep, for each child, a record showing the following information: (k) the date on which the child stops attending the community care facility.
Observation: Files for 10 children were reviewed. The last day of care was not recorded in four files.
Corrective Action(s): The last day of care needs to be recorded for all children.
Date to be Corrected: Today and ongoing.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: One chid has an epi pen and a care plan has not been developed in consultation with the parent or any person requested by the parent. The manager was unable to describe what actions would need to be taken if the child had a reaction requiring use of the epi pen.
Corrective Action(s): A current care plan must be available for all children who require extra support.

Comments

Summary of Inspection
At the inspection dated January 12, 2023 there were six children, one staff and one family member present. At this inspection the above noted contraventions were identified The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and written off site. A copy of this report will be emailed to the manager.
The following were discussed with the manager:
All minor/unusual incidents must be recorded in the Minor Incident log book.
It is the responsibility of the licensee/manager to ensure that families complete and return all required paperwork.
Photos of children are kept on a cell phone. It is recommended that hard copies of photos are kept in case the cell phone does not work.
It is the responsibility of the licensee to ensure the facility is in compliance with the Community Care and Assisted Living Act and the Child Care Licensing Regulation at all times. If the licensee is unsure of the requirements they must contact their Licensing Officer for clarification and guidance.
Children's records need to be kept for two years after a child leaves the facility.
All medications must be in the original container and if the medication is prescribed the original pharmacy label must be on the container.
Completing a monthly audit of the facility to ensure compliance with the legislation. It is recommended that the Care Care Links - My Checklist is used for this.
