Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child care Licensing Regulations (CCLR) and the relevant Director of Licensing of Practice (DLSP). All categories of care were inspected for compliance.

Contraventions

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Few walls in the facility had paint chipping and dry wall was exposed.
Corrective Action(s): Staff said that the manager was planning on painting the facility.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: During the routine inspection 5 staff files were reviewed. A Criminal Record Check on file is not site specific for one staff.
Corrective Action(s): Ensure each staff has a site specific CRC.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: During the routine inspection 5 staff files were reviewed and a minimum of two character references were not obtained for one employee.
Corrective Action(s): Ensure all staff files are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: During the routine inspection licensing reviewed 5 staff files. One staff had renewed their ECE certificate and a validation of the old certificate was present but no evidence that the new certificate was validated.
Corrective Action(s): Ensure ECE certificates are validated.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: During the routine inspection licensing observed that for the month of June 2024 the fire drill was not noted. Staff was unsure if the fire drill was conducted or not.
Corrective Action(s): Ensure fire drills are practiced and noted down monthly.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Fire Extinguisher has not been serviced annually
Corrective Action(s): Ensure fire extinguisher has been services annually.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: During routine inspection 9 children's files were reviewed and one child's file was missing an MSP number.
Corrective Action(s): Ensure all children's files are complete.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: During routine inspection 9 children's files were reviewed and one child's file was missing a date of enrollment.
Corrective Action(s): Ensure all children's files are complete.

Comments

At the inspection dated July 18, 2024 there were 21 children, 4 staff and an ECE Practicum Student present. At this inspection the above noted contraventions were identified. The licensee is required to address the contraventions, bring the facility into compliance, and provide a written response to Licensing by the date written below. Licensing will review the response.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following was discussed:
· Exemption decision forms to be posted at the center
· Licensing observed that the playground had minimal provision for shaded areas. A conversation was had with staff regarding provisions for protection from the elements such as sunshine and rain.
· Care plans for children requiring extra support to be dated and signed by the parents and staff
