Introduction

A scheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection. This inspection was conducted by Jennifer Fletcher alongside the Manger and the report was written by Sarah Hussain.

Contraventions
Previous Inspection - Contraventions observed on FIR #JMIA-AVYSEN have been corrected.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: It was observed that a rusty nail was sticking out from a broken piece of wood on a planter box located at the back fence area. A wasp nest was also observed against the building on the side walkway. There were several wasps noted in this area.
Corrective Action(s): Please ensure that all outdoor play materials and equipment are free from hazards.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Upon review of 4 staff records, it was noted that one staff's criminal record check had expired on April 2018.
Corrective Action(s): Please ensure that all staff have a current criminal record check on file.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Upon review of 4 staff files it was noted that one staff does not have validation of her ECE.
Corrective Action(s): Please ensure that all staff have validation for their ECE from the ECE registry.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: In conversation with the manager it was noted that a child under the age of 30 months attends both the preschool program as well as the daycare program. A temporary placement had been sent in on September 10th, however, an approval had not been granted and the child started attending since September 5.
Observed a child in care who exceeds the age allowed to attend the daycare program. The child is of school age and a temporary retention had been applied for on September 10. Approval for temporary retention had not been granted, however the child has been attending since September 5.
Corrective Action(s): Please ensure that children attending both programs are within the age requirement permitted in Schedule E. Temporary placement and temporary retentions are to be requested prior to children attending.

CARE AND/OR SUPERVISION: 14090 - CCLR s.40(2) - A licensee providing a care program described as Preschool (30 Months to School Age) must not provide care for more than 4 hours each day to each child.
Observation: In reviewing the attendance records it was noted that on three seperate days in September 3 children exceeded the hours allowed for preschool program. This piece of legislation was contravened on a previous routine inspection, July 2017.
Corrective Action(s): Please ensure that children in care do not exceed the allowed care hours for preschool of no more than 4 hours per day

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: On random review of 9 children's records it was noted that 3 were missing a medical insurance plan number and 1 was missing immunization status.
Corrective Action(s): Please ensure that all children's records have their medical insurance plan number and immunization status on file.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Upon random review of 9 childrens records it was noted that one child was missing a start date.
Corrective Action(s): Please ensure that each child's record shows the date of enrollment.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: On random review of 9 children's records it was noted that one child was missing their doctor's name and phone number.
Corrective Action(s): Please ensure that all children's records include a doctor's name and phone number.
Date to be Corrected: September 18, 2018.


Comments

During this routine inspection the following were discussed with the manager; temporary retention and temporary placement. Further information will be required from the manager regarding the temporary placement that was received on September 10, 2018. The request for temporary retention will be approved.
