Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection. Upon arrival, staff to child ratios were met for the programs which were operating (Group Under 36 months; Group 30 months to School-Age; and Preschool.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Policies and Procedures
As discussed policies will need to be developed for Active Play and Screen Time Use as per the Director of Licensing Standard of Practice. Information provided as per the Director of Licensing Standard of Practice for Active Play and Screen Time Use was provided at the last routine inspection. Copy of the policies and procedures in the staff binders were reveiwed from the Group 30 months to School-Age program noted that some of the policies in the parent handbook make reference to the previous Licensee. .
Staff Communication Books
Some of the staff communication books are shared. It is recommended that each program that is operating maintain their own communication book as opposed to sharing between programs - e.g. when groups of the same service type are separated in order to maintain staff to child ratios. Ensure that the dates indicating the year the entry was made is noted on all records (communication notes, log notes, accident forms, etc.)
February 21, 2018 - Manager confirmed that separate notebooks are in place for Group Under 36 month programs. In the morning children are divided into groups for the downstairs and upstairs program. When children leave from downstairs, staff ensure that the notebook is taken.
Custody Orders
A review of a child's file indicated that a custody agreement was in place regarding access. Staff advised that this likely was an error made by the foster parent and will review with the foster parent to make the appropriate correction. The Licensee requires that a copy of any legal orders regarding access be provided to ensure all staff are aware.
February 21/18 - Licensing reviewed an email sent by the foster parent advising that this child is under a CCO (continuos custody order) and that visits by parent(s) would only be in the presence of the Social Worker at the Social Worker's office. It is recommended that this information be placed on the child's file along with a copy of the order in the event that the person who is not permitted access arrives at the daycare. This will enable staff to expediate the process for the RCMP as a court order file number could be referenced.
Behaviour Plans
A review of the commuication notes indicate reoccuring behaviours from some of the children which may require a specific behaviour care plan. Licensing will mail out information regarding care plan considerations.
Use of High Chair
Manager discussed with staff that high chairs are not to be used for any type of restraint.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation (CORRECTED DURING INSPECTION): At the time of this inspection, verification of certificates for ECE and ECEA as established and maintained by the director of the early childhood educator registry was not found. Licensing discussed with the Manager a system that has been established to enable the Licensee to go on-line through the ECE registry to verify.
Corrective Action(s): Ensure a system to provide verification of certificates issued for ECE and ECEA staff is maintained to provide evidence of verification.
Date to be Corrected: February 21, 2018 Licensee provided copies of verification for ECE and ECEA staff.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: At the time of this inspection, a review of an attendance record for January 2018 noted that a child attended the Group Under 36 month program who did not meet the age requirement. Manager is aware and noted that this child was transitioning from Group Under 36 months to Group 30 months to School-Age. It was discussed that the transitioning plan should occur in sufficient time to allow the child integration into the new program so as not to contravene the above regulation. It was also discussed that in situations where more time may be needed for the transition, that an application to retain a child in the current program could be considered.
Corrective Action(s): Ensure requirements as set out in Schedule E are met for all programs.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: A random review of 18 children's records (combined for all programs) indicated that 3 of the records reviewed did not indicate the start date.
Corrective Action(s): Ensure start dates are indicated for each child in attendance.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: A random review of 18 children's records indicated 1 was missing Doctors name.
Corrective Action(s): Ensure all children's records indicate the Doctor's name.

RECORDS AND REPORTING: 19130 - CCLR s.57(2)(g) - A licensee must keep, for each child, a record showing the following information: (g) any notification of a parent, emergency contact or medical health officer made under section 55 [notification of illness or injury].
Observation: At the time of this inspection, minor incident logs were reviewed and indicated that some of the log notes did not indicate the extent of the injury and/or as to how the parent was notified. In discussion with the Manager, the Manager advised that a separate accident form would have been completed which requires the parent initial the form to evidence notification and then placed on the child's file. Licensing and the Manager cross referenced the log notes with the children's files and found that this practice was not consistent.
Corrective Action(s): Ensure where minor injury's occur that a record of notification is maintained. The system in place provides this evidence, however, the practice was not found to be consistent with all staff.
