Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSOP). All areas of the facility were inspected for compliance. Two LO's were present for training purposes.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Manager's name was not posted.
Corrective Action(s): Please ensure manager's name is posted and visible.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing noted that diaper cream was stored in a drawer accessible to children and baby wipes were showing signs of molding. The sandbox in the playground was uncovered when not in use.
Corrective Action(s): Please ensure harmful substances are inaccessible to children and a healthy and safe environment is provided at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11180 - CCLR s.16(4)(a) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (a) suitable for the age and development of the children.
Observation: IT outdoor playground is lacking in materials for children to engage with. Licensing noted that the climber that was set up is not developmentally appropriate. Children did not seem to be engaged in outdoor play.
Corrective Action(s): Please ensure there are enough materials for children to participate in developmentally appropriate outdoor play.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: Climber in the 3-5 program was noted to have signs of chipped edges and worn out wooden surfaces and lacked sufficient clearance which can result in potential injury should a child fall. Please refer to DLSOP Safe Play Spaces. It is noted that the staff provided a good level of supervision while in use.
Corrective Action(s): Please ensure all materials and equipment are safe and free of hazards.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: 3 of 5 staff files were missing immunization status.
Corrective Action(s): Please ensure there is a system in place to guarantee completion of staff's documentation.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: 3 of 5 staff files were missing validation from ECE Registry.
Corrective Action(s): Please ensure staff's ECE certificates are validated.

NUTRITION AND FOOD SERVICES: 17050 - CCLR s.48(3)(a) - A licensee must ensure that the food and drink given to a child is sufficient in quantity and quality to meet the developmental needs of the child, having regard to (a) the child's age.
Observation: During lunch time, only 2 children had their water bottles on the table. Staff informed Licensing that children are given water bottles only when they ask for it.
Corrective Action(s): Please ensure children are being offered their water bottles throughout the day.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: During the audit of children's files, it was found that 3 were missing immunization status.
Corrective Action(s): Please ensure there is a system in place to guarantee completion of children's files.

RECORDS AND REPORTING: 19370 - DLSOP Safe Play Space (maintenance of equipment [b3]) - [bullet 3] Keep a log of all inspections, maintenance and repairs.
Observation: Licensing noted that there is no documentation showing inspection and maintenance of outdoor playground.
Corrective Action(s): Please ensure there is a log book or a checklist to ensure daily monitoring of the playground.

Comments

Summary of Inspection:

At the inspection dated Sept. 19, 2019 there were 20 children and 5 staff present. At this inspection the above noted contraventions were identified. Day 1 of the inspection concluded with observations discussed with the manager. Inspection report was completed off-site and will be reviewed with the manager on Friday, Sept. 20.

As part of this Routine Inspection, a Facility Risk Assessment Tool is completed and a copy provided.

During the discussion about the outdoor playground, manager stated that a walk-through is being completed everyday, but there is no documentation of these inspections. Licensing noted that there were pieces of paper throughout the playground, as well as loose part pieces. Manager discussed modifying climber in the 3-5 program for sufficient clearance.

Shared lunch time observations with the manager. Licensing observed that only a few children had bowls and utensils and the rest were eating off the table using their hands. When it was discussed with staff, they then provided children with bowls and utensils. Dishwashing method was observed and Licensing informed staff about the 3-sink method.

Monitoring of fridge temperature was discussed and manager has created a system to document fridge temperature (must be 0-4 Celsius).

Overall program schedule was discussed with manager and the importance of remaining flexible in accordance with Schedule G of CCLR. Licensing discussed with the manager the noted tone and calling out of a child's name in the program, as well as the importance of getting down to the child's level, staff role modeling and creating a warm atmosphere.

Communication book provides good detail and information of day-to-day events.

A follow-up inspection will be conducted to ensure the contraventions that have been identified have been brought into compliance. Additional time will be spent for observation of the program and activities.
