Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the manager is not posted.
Corrective Action(s): Please post the name of the manager.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 1 staff had a criminal record check from the RCMP. 3 staff had criminal record checks addressed to another employer.
Corrective Action(s): Please ensure that criminal record checks are completed through the criminal review program in Victoria. Employees may share their criminal record check with another employer by completing the sharing form. The criminal record check bulletin was provided.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: 1 of 5 staff files did not contain evidence of immunization
Corrective Action(s): Please obtain evidence of each staff persons immunization.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation (CORRECTED DURING INSPECTION): 3 of 5 staff files reviewed did not contain verification of ECE or ECEA certificates. This is a repeat contravention. The Manager corrected this during the inspection.
Corrective Action(s): Please ensure that each ECE or ECEA certificate is verified by the system established and maintained by the ECE registry

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The staff stated that the fire drills and emergency drills were completed but was unable to provide a record.
Corrective Action(s): Please keep a record of fire drill and emergency plan.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: 3 medications observed did not have specific times or amounts to administer to the child.
Corrective Action(s): Please ensure that medication is administered in the specific times and amounts directed by the parent.

MEDICATION: 16020 - CCLR s.53(1)(b) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (b) readily accessible to employees.
Observation: One child's life saving medication was not available at time of inspection.
Corrective Action(s): Please ensure any life saving medication agreed to be given to a child is readily available to the employees.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: 2 weeks of attendance records were reviewed and 1 day a child did not have a departure time.
Corrective Action(s): Please ensure that each child has a time of arrival and departure documented.

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: One child requiring a careplan does not have a relevant diagnosis to the need for the life saving medication.
Corrective Action(s): Please review care plan and add diagnosis.

Comments

Discussed with the manager the following information
· Active supervision and the need to have visual and auditory supervision of the children.
· The necessity of flushing the taps prior to use every morning. This can be done by letting the water run at the tap for 5 minutes.
· The Manager is aware that she must contact a Licensing officer within 24 hours after a reportable incident occurred.
