Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Furniture, equipment, and/or fixtures were in disrepair, including:
Washroom counter damaged
Washroom debris on the floor and on the walls
Classroom table has damaged stickers affixed
Walls appear damaged from cleaning products
Outdoor garbage full and not maintained recently.
The LO reviewed these items with the manager.
Corrective Action(s): Ensure the facility, furniture and the equipment is clean and in good repair at all times.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one or more employees.
Corrective Action(s): Ensure all staff files are complete including immunization status.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: One staff working in the program at the time of the inspection did not have evidence of the ECE Certificate being validated through the ECE Registry.
Corrective Action(s): Ensure all staff files are complete including validating ECE certificates.

CARE AND/OR SUPERVISION: 14270 - CCLR s.52(1)(b) - A licensee must ensure that a child, while under the care or supervision of the licensee, is not subjected to any of the following: (b) confinement or physical restraint by an employee, except as authorized in a child care's plan if the care plan includes instructions respecting behavioural guidance.
Observation: Two children were observed sitting in highchairs for an extended period of time for snack and circle time. In addition one of the children was older and based on the age and development not suitable to be using the highchair. The LO reviewed this observation with the staff and manager in depth.
Corrective Action(s): Ensure children are not confined or use equipment not developmental suitable.

NUTRITION AND FOOD SERVICES: 17020 - CCLR s.48(1)(b) - A licensee must (b) promote healthy eating and nutritional habits.
Observation: Children were observed eating snack at the time of the inspection. LO reviewed healthy eating habits with the staff supervising the children.
Corrective Action(s): Ensure healthy eating and nutritional habits are promoted and followed.

Comments

On the inspection date of April 17, 2024 there were 5 children and 2 staff present. At this inspection the above noted contraventions were identified. Actions required by the licensee include a corrective action plan required to be submitted and actions required the LO include to review and monitor corrective action plan. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided. This inspection report was completed off site, reviewed with the Manager who was not available during the inspection and then emailed to the facility the same day.
Discussions took place regarding the following topics:
Use of empty classroom space and personal belongings
Staffing qualifications
Active Supervision
Staff CRC status
Health and Hygiene Preventative Practices
Outdoor play equipment placement
