Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance with the exception of the emergency supplies.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: During the inspection the following was observed outside the facility:
-Rust was noted in the middle of a spool in the outdoor play area. This can cause a potential health hazard. This is a repeat contravention from inspection #SMOY-BRJTAH, #CLAN-CBYN2W, # CLAN-C9HVST, CLAN-BH2Q3W
-In discussion with the Manager she states the staff wash tongs used for serving children's snack in the washroom sink. Licensing recommended that the program wash the tongs in the sink in the church kitchen or use disposable items as there could be cross contamination from the bathroom sink to the food items. This is a repeat contravention from inspection # SMOY-BRJTAH, # CLAN-C9HVST. Please correct by November 22, 2022
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the following inside the facility:
-Baseboards in the washroom had paint chips and signs of wear. This is a repeat contravention from inspection #CLAN-BH2Q3X and #SMOY-BRJTAH, #CLAN-CBYN2W, CLAN-C9HVST
Corrective Action(s): Please ensure the facility is in good repair

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Upon arriving at the facility licensing observed a door to a shed was unlocked. Located in the shed on the floor was a bag of ice melter. This could pose a potential hazard to the children in care.
Inside the classroom Licensing observed a bag with personal items belonging to one of the staff. This could present a potential hazard. This is a repeat contravention from inspection # CLAN-BH2Q3X and #SMOY-BRJTAH. This was corrected during the inspection.
Corrective Action(s): Please ensure the children do not have access to any object or substance that may be hazardous to their health and safety.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed two staff records of four. One staff record was missing a site specific criminal record check. This is a repeat contravention from inspection #SMOY-BRJTAH.
Corrective Action(s): Please ensure staff records are complete with current information.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: One staff record was missing one character reference. This is a repeat contravention from inspection #SMOY-BRJTAH
Corrective Action(s): Please ensure staff records are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one employees. This is a repeat contravention from inspection #SMOY-BRJTAH.

MEDICATION: 16010 - CCLR s.53(1)(a) - If a licensee has agreed with a parent to give a child any medication prescribed by a medical practitioner or provided by the parent, the licensee and his or her employees must ensure that the medication is (a) administered to the child in the amount and at the times specified by the child's parent or in the child's record or care plan.
Observation: A child at the facility requires occasional medication. Licensing reviewed the documentation and did not observe a record of the medication given to the child. In addition the medication authorization form was not signed by a parent or a medical practitioner.
Corrective Action(s): Please ensure a medication authorization form is signed by the parent prior to administering a child's medication and the date and time of administration of medication is documented by the staff.

Comments

At the inspection dated November 21, 2022 there were 20 children, 2 staff, 1 practicum student and the Manager was present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by December 6, 2022 unless otherwise specified in the report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Manager.

The following education/recommendations were provided:
-The reportable incident reporting procedure. Forms and the bulletin were given
-The current cleaning protocols that are in place
-Preventing lead in the water
-Updating policies and procedures
