Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act, Child Care Licensing Regulationand the relevant Director of Licensing Standards of Practice. All areas of the facility were inspected for compliance except for the facility's policies and procedures as there have not been any changes since the previous routine inspection.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: During the inspection the Licensing Officer was unable to locate the name of the Manager posted. Staff's early childhood educator certificates and the facility licence were posted but not the name of the facility Manager.

Corrective Action(s): Please post the name of the facility Manager by the above noted documents.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: In the main activity room the Licensing Officer observed signs of water damage around various windows. Around the windows the wall paper is damaged and there are areas where the gyproc and metal cladding are exposed. In discussion with the staff they have not observed any water entering through the windows.

There is a section of wood fence that is falling over. The adjacent property is presently being built and the fence will be replaced in the near future.

Corrective Action(s): The windows where the gyproc is damaged will need to be repaired. There is the potential for the children to access this area and these areas are no longer cleanable as they are porous. Staff should make these areas inaccessible to the children until the repairs are completed. The correction date for this is February 18, 2020.

The Licensee must ensure that the area of fencing that is unsafe is made inaccessible to the children to prevent and child from being injured. The correction date for this is January 28, 2020.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11190 - CCLR s.16(4)(b) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (b) safely constructed, free from hazards and in good repair.
Observation: There are a number of pieces of equipment for children's use outdoors. This includes a climbing structure, slide, and a individual trampoline. As all of these items are over 18" high they must be located on resilient ground cover to prevent a child from injury and not on the grass, cement or patio.

Corrective Action(s): The above noted equipment must not be used until they are situated on resilient ground cover. The Licensing Officer left a copy of the Director of Licensing Standards of Practice - Safe Play Space document which outlines the requirements for resilient ground cover.

STAFFING: 12110 - CCLR s.19(2)(b) - A licensee must not employ a person in a community care facility unless the licensee is satisfied, based on the information available to the licensee under subsection (1) and the licensee's or, in the case of an employee who is not the manager, the manager's own observations on meeting the person, that the person (b) has the personality, ability and temperament necessary to manage or work with children.
Observation: The Licensing Officer reviewed 2 staff files and noted that one file did not contain any evidence that the individual's references were verified.

Corrective Action(s): The Licensee has made note in the other staff files indicating that they verified the references. The Licensee must implement a system to ensure all staff references are verified prior to the individual working with children.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Upon review of two staff files there is one file where the individual's early childhood educator certificate was renewed however the Licensee has not verified the current certificate. The certificate had expired in December 2017 and the verification was completed on February 17, 2017. This individual holds a current certificate.

Corrective Action(s): Ensure verification of individuals early childhood certificates are conducted on a regular basis.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Upon review of two staff files the Licensing Officer noted that both individuals criminal record clearance letters expired on December 15, 2019. In discussion with the Manager both staff applied to renew their criminal record checks last week.

Corrective Action(s): The Licensee must ensure that criminal record clearance letters are kept current and apply to have them renewed prior to the expiry date.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: The Licensing Officer noted the next service date for the fire extinguisher is October 2019. The fire extinguisher indicates that it is fully charged.

Corrective Action(s): The Licensee must ensure that the fire extinguisher is serviced on or before the date of the service tag to ensure the effectiveness of the fire extinguisher.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The facility maintains a list of when fire drills and emergency drills are conducted. The last fire drill recorded was September 2019 and there is no record for an emergency drill.

Corrective Action(s): In discussion with both staff they stated that they have done an emergency drill and fire drill but haven't maintained accurate records.

Comments

At the inspection dated January 28, 2020 there were 2 staff and 7 children present. At this inspection the above noted contraventions have been identified and any action required by the Licensee is included. As part of this routine inspection a Facility Risk Assessment Tool is completed and a copy is provided.

During today's inspection the Licensing Officer and the Manager discussed temporary retentions. Licensing clarified that once a child turns 3 years of age they are no longer able to attend a group child care (under 36 months) program as they no longer meet the age requirements.

Staff inquired about screen time in group child care (under 36 months) programs. The Director of Licensing Standards of Practice - Active Play, page 2 states: "All licensed child care programs must limit screen time (tv, computer, electronic games) to 30 minutes or less a day. Screen time is not offered to children under two years of age". At the present time this facility has a no screen time policy. The Licensing Officer left a copy of the Active Play document for staff to reference.

This report was reviewed with the Manager prior to signing.
