Introduction

CCFL is on site to follow-up and assess compliance with the Community Care and Assisted Living Act(CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP).

Contraventions

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10080 - CCLR s.12(1)(a) - During an investigation or inspection, a person must not do either of the following: (a) obstruct a medical health officer.
Observation: The licensee did not show where the other children were until the Licensing Officer opened the door to the upstairs bedroom where 5 chidren were found in a playpen.
Corrective Action(s): The Licensee is to ensure that they are always forthcoming with the Licensing and the Licensing Officer.
Date to be Corrected: July 4, 2019.

CARE AND/OR SUPERVISION: 14010 - CCLR s.34(1) - A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation: The Licensing Officer observed that the 9 children in the basement of the facility were being supervised by a Responsible Adult.
Corrective Action(s): The Licensee is to ensure that children are supervised by staff who hold ECE cerification.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: The Licensing Officer observed 7 children under the age of 3 and 7 children older than the age of 3, totally 14 children present at the facility.
Corrective Action(s): The Licensee is to ensure that the ages and numbers of the children meet the requirement under the Child Care Licensing Regulation.

CARE AND/OR SUPERVISION: 14360 - CCALA s.7(1)(b)(i) - A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation: The Licensing Officer found that 5 children in an upstairs bedroom in a playpen with no supervision.
Corrective Action(s): The Licensee is to ensure that children are not left in a room, 2 floors up in the facility with no supervision.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: The Licensing Officer reviewed the attendance records and found that attendance had not been kept since June 21, 2019.
Corrective Action(s): The Licensee is to keep accurate attendance records to ensure that all children would be accounted for in the event of an emergency.

Comments

Upon arrival, the Licensing Officer knocked on the door and window but no one answered the door.
The Licensing Officer called the Licensee who stated that she would be there momentarily.
Once the Licensee arrival, Licensing was admitted to the facility.
It was found that 9 children is where the facility is located, there were the following:
-3 children younger than 3 years old
-3 children who were 3 years old
-3 children who were 4 years old

Once it was found the Licensee was over numbers, the Licensing Officer checked the rest of the facility.
The Licensee did not admit that more children were on site.
The Licensing Officer found that 5 more children were in an upstairs bedroom in a playpen with no supervision.
There were the following:
-2 children who 1 year old
-2 children who were 2 years old
-1 child who was 4 years old

The total number of children on site today was 14.

Licensing Officer, Kristen Fibich attended this inspection.
The Licensee made arrangements for 6 children to be picked up immediately.

The Licensing Officer, Kristen Fibich took photographs of the attendance records for June, 2019.
Copies of photographs offered to the Licensee.
Actions to be taken by the Licensee: Health and Safety Plan for the staff, submit a plan re: children attending and meet with the Licensing Team.
