Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSOP). All areas of the facility were inspected for compliance.
This inspection was conducted during the Covid-19 pandemic.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed staff immediately store children's mats away after nap time. As per the CDC guidelines for Covid-19 children's mats need to be disinfected daily. The manager stated mats are always sprayed down after nap however the staff must have forgotten.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A selection of staff files were reviewed. Out of the 4 reviewed, 2 files did not contain a criminal record check. The licensee contact has submitted an application for 1 staff.
Corrective Action(s): This is noted as a repeated contravention. Please ensure employees have obtained a valid and clear criminal record check.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: A selection of staff files were reviewed. Out of the 4 reviewed, 1 file only contained 1 reference for the staff.
Corrective Action(s): Please ensure 3 character references in respect of the person is on file.

CARE AND/OR SUPERVISION: 14010 - CCLR s.34(1) - A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation: Upon arrival at the facility there were 16 children signed in with an ECE I/T and Responsible Adult. A review of the staff schedule showed an ECE I/T and 2 Responsible Adults in the 3-5 room with 21 children. The licensee contact (ECE) stated she was also present in the morning and was on her break at the time Licensing arrived.
Corrective Action(s): This is noted as a repeated contravention. Please ensure children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: A random selection of children's files were reviewed. Out of the 7 reviewed, 1 did not contain a MSP number.
Corrective Action(s): This is noted as a repeated contravention. Please ensure a record showing the medical insurance plan number is on file.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: A random selection of children's files were reviewed. Out of the 7 reviewed, 1 did not contain the date of enrolment.
Corrective Action(s): This is noted as a repeated contravention. Please ensure a record showing the date of enrolment in the community care facility is on file.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: A random selection of children's files were reviewed. Out of the 7 reviewed, 1 did not have contact information for a medical practioner.
Corrective Action(s): This is noted as a repeated contravention. Please ensure a record showing the name and telephone number of a medical practioner is on file.

RECORDS AND REPORTING: 19250 - CCLR s.58(2)(a) - The licensee must (a) develop the care plan in consultation with a parent of the child requiring extra support and any person requested by the parent.
Observation: A random selection of children's files were reviewed. Out of the 7 files reviewed, 4 files contained information about children that require extra support. Care plans for these children have not been created.
Corrective Action(s): This is noted as a repeated contravention. Please ensure a care plan in consultation with a parent of the child requiring extra support is on file.

Comments

At the inspection dated October 20, 2020 there were 16 children and 3 adults present.
At this inspection the above noted contraventions were identified.
Action required by the licensee includes providing a written response by October 27, 2020.
Actions required by licensing include review the written response and due to the nature of the contraventions a follow-up will be conducted.

Due to Covid-19 no signatures were obtained for this report.
The manager was on site for part of today's inspection, the contraventions were discussed with the manager over the phone. The report was written at the CCFL office and emailed to the Manager on October 22, 2020.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

The following education/recommendations were provided:
- Covid-19 Infection control assessment was completed over the phone with the manager
-Licensing observed the hot water turned off in the facility. It is highly recommended the hot water is turned back on and maintained under 49 degrees celcius as warm water is recommended for proper handwashing, disinfecting and sanitizing.
- There are currently 2 out of 4 staff that do not have a valid First Aid. The manager stated these staff have completed the first aid, however a certificate could not be produced. A discussion was had with the manager to ensure children always have access to someone with valid first aid.
- A Work Safe Plan will need to be created and posted
- The manager will need to update the health and illness policy in accordance with the new CDC guidelines
