Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), and the Child Care Licensing Regulations (CCLR), and the Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: -Outdoor stairs were enclosed with rope, however some gaps were more than 3.5 inches in size, providing entrapment concern.
-Grass in one area was long, and where a water hose was located and not visible due to the height of the grass. This provides a tripping hazard for young children.
-two bedrooms that are located in the non-facility area, were accessible to children during care. One space is where the emergency exit is located.
Corrective Action(s): Please ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: -Cupboard under the sink was unlatched providing children access to two bottles of bleach.(cupboard was latched after licensing pointed out the accessibility to children).
-One drawer a child was opening at the time of the inspection, stored cables, and electrical cords.(moved out of reach of children during inspection).
-electrical baseboard heater had been newly installed, without a cover giving access to children while playing. The base board was on and hot to touch during the inspection. (turned off, and a table was moved in front during inspection)
Corrective Action(s): Please ensure that children do not have access to any object or substance that may be hazardous to the health or safety of children.
Date to be Corrected: Please provide long term corrective plan for the heater by November 1, 2023

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: One of three staff had no current criminal record check completed at the time of the inspection. Licensee said it had not been submitted.
Corrective Action(s): Please ensure to obtain a criminal record check for each staff prior to working at the facility.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Of three employee files reviewed two files did not contain record of checking references, prior to staff working.Licensee said for one staff file two references were called, but not documented, and for the other staff file, one reference was called and had not been documented.
Corrective Action(s): Please ensure to first obtain the character references prior to employing the person.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Of three employee files reviewed, two files had no record of the employee ECE or ECEA having been verified by the system maintained by the early childhood educator registry.
Corrective Action(s): Please ensure to obtain record of having verified ECE or ECEA employee certificates.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: During the inspection it was observed by licensing that there were 4 children under 3 years in attendance of the program.
Corrective Action(s): Please ensure that children attending the community care facility are divided into groups with each group having no more than permitted in schedule E.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Eight children's files were reviewed, of those, two were missing emergency contact information, and one was missing contact number for medical practitioner
Corrective Action(s): Please ensure to keep record for each child, the phone number of medical practitioner, and emergency contact.

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: Eight children's files were reviewed, of those, 2 were missing consent to call a medical practitioner or ambulance in case of an accident.
Corrective Action(s): Please ensure to keep record in writing from a parent and maintain at the community care, consent to call a medical practitioner or ambulance in case of accident or illness.

Comments

Summary of Inspection:
During today’s inspection, there were 8 children, the licensee and 2 support staff present.
At this inspection the above noted contraventions were identified. Written response is required once licensee once contraventions are addressed.

The following was discussed:
Discussed posting manager's name in visible location
Licensing reviewed requirement for developing systems to keep and maintain records.
Licensing observed guidance practices, that were differing to what is detailed in the facility policies. Licensing provided educational resources that support guidance practices in the facility polices, such as redirection, and giving choices to children.
Care plan education provided.
