Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All care categories were inspected for compliance.

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Four staff files were reviewed. One file contained a criminal record check that had not been obtained through the CRC Agency sharing program.
Corrective Action(s): If a criminal record check is from another facility it must be obtained through the CRC Agency sharing program.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Four staff files were reviewed. References were not available in three files.
Corrective Action(s): Please ensure a minimum of two verified references are available in all staff files.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Four staff files were reviewed. A resume was not available for three staff.
Corrective Action(s): Please ensure a resume is available for all staff.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Four staff files were reviewed. Immunization status was not obtained for two staff. This is repeat noncompliance and was noted on Routine Inspection #WBET-C3ZR5X dated June 15, 2021.
Corrective Action(s): Please ensure immunization status is available for all staff.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Four staff files were reviewed. An ITE and an ECE certificate had not been verified.
Corrective Action(s): Please ensure all ITE, ECE and ECEA certificates are validated through the ECE Registry.

STAFFING: 12170 - CCLR s.21(1) - A licensee must not continue to employ a person in a community care facility unless the licensee has evidence that the person continues to comply with the Province's immunization and tuberculosis control programs.
Observation: Four staff files were reviewed Immunization status was not available in two files.
Corrective Action(s): Please ensure immunization status is available for all staff.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: The emergency supply kit contained numerous food items that had expired and there were not enough supplies for eight children for up to 72 hours.
Corrective Action(s): Please ensure the emergency kit contains enough supplies for up to 72 hours.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: At todays inspection five children, the manager and one staff person were present. The manager informed Licensing that the staff person does not have any child care qualifications and is covering for an ECE staff person. On review of facility records, Licensing noted that from January 6, 2022 - March 21, 2022 the second staff person working at the facility was qualified as a Responsible Adult. Staffing not complying with Schedule E CCLR was noted on Routine Inspection #WBET-C3ZR5X dated June 15, 2021.
Corrective Action(s): When four or more children are in attendance the second staff person needs to be an ECE or if the ECE is away the second staff person needs to be an ECEA. Please ensure staffing is in compliance with Schedule E CCLR at all times.

RECORDS AND REPORTING: 19051 - CCLR s.56.1(2)(a) - A licensee must keep (a) a copy of the written statement, referred to in section 19 of the Act, that the licensee delivers to persons who prepay part of the cost of services
Observation: Files for eight children were reviewed A parent contract was missing in two files. This is repeat noncompliance and was noted on Routine Inspection #WBET-C3ZR5X dated June 15, 2021.
Corrective Action(s): Please ensure a copy of the parent contract is available in all children's files.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Files for eight children were reviewed. An emergency contact was not available for one child. This is repeat noncompliance and was noted on Routine Inspection #WBET-C3ZR5X dated June 5, 2021.
Corrective Action(s): Please ensure an emergency contact is available for all children.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Files for eight children were reviewed. A photograph was not available in one file.
Corrective Action(s): Please ensure a photograph of all children is available.

RECORDS AND REPORTING: 19210 - CCLR s.58(1)(a) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (a) the diagnoses relevant to the child's requirement for extra support, as made by health care professionals.
Observation: No care plan available for a child who has a food allergy.
Corrective Action(s): Please ensure a care plan is available for all children with food allergies.

Comments

Summary of Inspection
At the inspection dated June 7, 2022 there were five children and two staff present. At this inspection the above noted contraventions were identified. The Licensee will take action to bring the facility into compliance and provide a written response to the Licensing Officer. The Licensing Officer will review the response. As part of this routine inspection, a facility risk assessment tool is completed and a copy is provided. This report was reviewed with the manager and written off site. A copy of this report will be emailed to the manager.
The following were discussed:
Sun safe practices - ensuring children have sun hats and sunscreen is applied before children go outside. Ensuring parents give written permission for staff to apply sunscreen and making sure containers of sunscreen have not expired.
