Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed:
· Licensing, Physical Facility, Staffing, Polices & Procedures, Care & Supervision, Hygiene and Communicable Disease Control, Medication, Nutrition and Food Services, Program, Records and Reporting
As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

The following were reviewed and/or discussed: Supervision practices/policies (bathroom, transportation etc), Reportable Incident process, Flushing water pipes, Bill 5 amendments

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The name of the manager is not displayed in the facility.
Corrective Action(s): Please ensure that the name of the manager is displayed.

STAFFING: 12030 - CCALA s.7(1)(a) - A licensee must do all of the following: (a) employ at a community care facility only persons of good character who meet the standards for employees specified in the regulations.
Observation: The staff file for the manager was not available during this inspection. CCFL was not able to determine if the information at the facility for the manager is current.
Corrective Action(s): Please ensure a staff file is available for all staff.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A criminal record check was missing in 1 staff file. It appears that the criminal record check is at the Facility but could not be located during this inspection.
Corrective Action(s): Please ensure a criminal record check is available in all staff files.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: References were not available in 1 staff file.
Corrective Action(s): Please ensure references are available in all files.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was missing in 1 staff file.
Corrective Action(s): Please ensure immunization status is available in all staff files.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: In the Group Child Care (under 36 mos) Escargot there is no Infant Toddler Educator at 3:15pm when one staff leaves.
Corrective Action(s): An Infant Toddler Educator needs to be present at all times in this program.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Children in the Group Child Care (under 36 mos) are transferred from one group to another. Accurate time into the second group is not being recorded for all children.
Corrective Action(s): Please ensure that the time children are transferred form one group to another is accurately recorded.

Comments

CCFL reviewed an application to temporarily place 5 children in the Group Child Care ( 30 mos -school age) with facility staff. The request appears to pose no risk to the health and safety of children in care and appears to be in the bet interests of the children named in the application. The application is approved and CCFL will forward a letter of approval to the facility.

CCFL was informed that one of the Group Child Care (under 36 mos) classrooms will be removed from the program by the school in September 2018 to be used as a kindergarten. Staff do not know which room will be used by the school yet. The facility is constructed with an open plan design and the remaining Group Child Care ( 30 mos - school age) room will need to be separated from the kindergarten class. CCFL requests that they are informed as soon as possible regarding the plan to make the child care facility inaccessible to the kindergarten program.

CCFL recommends the following:
A copy of the Child Care Licensing Regulation be easily accessible to all staff so that staff can refer to it during their daily work.
A review of the staff file systme takes place so it is easily determined who are current staff, who are substitute staff and which staff no longer work at the facility.
