Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Manager name was not displayed at the time of today's inspection.
Corrective Action(s): Please ensure that manager's name is prominently displayed in the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing staff observed in playroom that the height of one table top was same as toddler height . One corner of the table need to be secured from hitting or bumping children head with the table.
Corrective Action(s): Ensure safe and healthy environment is provided to children at all times.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Toys and equipment in the outdoor play area were dirty and has grim on some of the toys. The manager stated they will wash the toys.
Corrective Action(s): Ensure facility is clean and in good repair while children are in attendance.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: Licensing observed that 2 electric outlets in the hallway were exposed and were accessible to children.
Corrective Action(s): Ensure children do not have access to anything that may be hazardous for their health and safety.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Review of 3 staff files noted one staff has expired criminal record clearance (CRC) copy on file.
Corrective Action(s): Ensure all staff has a valid CRC on file. As a health and safety plan, staff with expired CRC will not be left alone to work with children until a valid CRC is obtained.
Date to be Corrected: Manager stated they will send CRC application by end of this week.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: Review of 3 staff file found one staff was missing a copy of resume or work history on file.
Corrective Action(s): Ensure staff file are complete.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: All 3 staff working at the time of inspection were missing immunization status on their file.
Corrective Action(s): Ensure staff files are complete.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Review of 3 staff files found 2 staff are missing ECE verification on their file.
Corrective Action(s): Ensure staff files are complete

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Review of facility records noted documentation of fire drills was complete. However, annual emergency drill was not documented in facility records.
Corrective Action(s): Ensure facility records are complete.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: There were 8 children in attendance at the time of inspection however only 6 children were signed in with their arrival time.
Corrective Action(s): Ensure facility records are complete.

Comments

Summary of Inspection
At the inspection dated December 4, 2018 there were 8 children and 3 staff present. At this inspection the above noted contraventions were identified. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
The manager will correct the items of non-complaince by correction dates provided by licensing staff. A follow up inspection will be conducted to review items of non-compliance.
