Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were reviewed for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation (CORRECTED DURING INSPECTION): During inspection Licensing noted two windows, facing the front yard, accessible to children were opened wide enough for a child to fit through.

Licensing reminds staff that a screen does not prevent a child from falling out a window.

Staff closed the windows during inspection.
Corrective Action(s): Ensure windows that are accessible to children are only opened if they have child safety equipment blocking with windows from being open far enough for a child to fit through.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11180 - CCLR s.16(4)(a) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (a) suitable for the age and development of the children.
Observation (CORRECTED DURING INSPECTION): During inspection Licensing observed children who at least two years of age in high chairs.
Licensing reminds staff to follow the manufacturers instructions for use when using high chairs to ensure they are being used for children of an appropriate age.

During inspection staff had older children sitting in chairs at a table instead of in high chairs.
Corrective Action(s): Ensure high chairs are being used in a safe manner.

STAFFING: 12100 - CCLR s.19(2)(a) - A licensee must not employ a person in a community care facility unless the licensee is satisfied, based on the information available to the licensee under subsection (1) and the licensee's or, in the case of an employee who is not the manager, the manager's own observations on meeting the person, that the person (a) is of good character.
Observation: During inspection Licensing reviewed staff files and noted that there is no proof that their character references had been checked.
Corrective Action(s): Ensure there is proof on file that the Licensee has checked each staff person's character references.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: During inspection Licensing reviewed staff files and was unable to find proof that the staff ECE certificate had been verified on the ECE Registrar website.
Corrective Action(s): Provide proof on staff file that ECE certificate has been verified.

STAFFING: 12200 - CCLR s.22(2)(c) - A licensee must ensure that each employee (c) practices implementing the emergency plan at least once each year.
Observation: During inspection Licensing reviewed fire/ emergency drill log and noted that there was no log note showing that a full emergency evacuation, taking all emergency evacuation supplies, had been conducted in a 12 month period.
Corrective Action(s): Ensure staff conduct a full emergency evacuation drill on an annual basis and record it when completed.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: During inspection Licensing reviewed staff files and noted one staff person has a Criminal Record Approval letter not addressed to the Licensee.
Corrective Action(s): Ensure Criminal Record Approval letter is addressed to the Licensee as per the Criminal Record Review Act.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: During inspection staff were not able to tell Licensing where the emergency evacuation supplies, for 72 hours, were stored.
Corrective Action(s): Ensure all staff working on site know where all emergency equipment is located.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: During inspection Licensing noted that there were two children in care who are 36 months of age.

Licensing spoke with the Licensee about the temporary retention process.
Corrective Action(s): Ensure children in care meet the age restriction of an under 36 month child care program.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: During inspection Licensing reviewed staff documentation and noted that though one staff person has proof that they have taken ECE training, they do not have their ECE certificate to practice in BC which is issued by the ECE Registrar.

Licensing discussed the exemption process with the Licensee.
Corrective Action(s): Ensure staff to child ratio is being met at all times while children are in care.
Date to be Corrected: June 14, 2019.

HYGIENE AND COMMUNICABLE DISEASE: 15030 - CCLR s.46(1) - A licensee must establish a program to instruct children in, and to practise the rules of, health and hygiene.
Observation (CORRECTED DURING INSPECTION): During inspection staff stated that they dry children's hands either with a child wipe, or just use one hand towel for all children.

During inspection staff used individual towels when drying children's hands
Corrective Action(s): Ensure either paper, or individual towels, are used to dry children's hands to help to prevent the spread of germs.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: During inspection Licensing reviewed children's records and noted that one child is missing their medical insurance number and immunization status.
Corrective Action(s): Ensure all missing information is included on this child's file.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: During inspection Licensing reviewed the sign in/ out sheet and noted not all children have time of departure noted on multiple days
Corrective Action(s): Ensure accurate time of arrival and departure is recorded throughout the day as this information is used by emergency personnel in times of emergency.

Comments

At the inspection dated June 13, 2019 there were 7 children and 2 staff present. At this inspection the above noted contraventions were identified.
Licensee to submit written documentation outlining how the violations will be met and by when.
Licensing officer will conduct a follow up inspection.
* Licensing reminds staff to remove the alcohol wipes from their first aid kit as they are classified as medicine (with a D.I. Number) and you need parental consent to administer.

* During inspection Licensing reviewed children's files and noted not all children have a physical photo on site. One staff person stated that they have a photo of each child on their personal phone. Licensing notes that this meets the intent of the legislation of having a photo or digital image of each child in care but questions what happens if this staff person's personal phone is not on site during daycare hours.

* During inspection Licensing noted that there is nothing written on the fire extinguisher showing when it was purchased. Licensing reminds the Licensee that the fire extinguisher needs to be serviced annually.

Licensing discussed with staff different circle time practices with regard to circle times with children under the age of 36 month.

During inspection Licensing observed children engaged in a circle time, creating an adult directed craft and then engaged in free play outside, and then they came inside for lunch. Licensing observed staff interacting with children while they were engaged in activities.

As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.
