Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation (CORRECTED DURING INSPECTION): Manager's name was not posted in the facility. This was discussed during routine inspection # SMIA-CQ7PEA dated 23 March 2023. Manager corrected this during inspection.
Corrective Action(s): Manager's name must be posted in a prominent place in the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation (CORRECTED DURING INSPECTION): During inspection licensing observed the edge of one the laminate floor panel is in disrepair.Manager is aware of this as it was observed last week, there is a plan to replace it in the coming weeks. Manager corrected this during inspection.
Corrective Action(s): Please ensure the flooring is in good repair and free of hazards when children are present.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Licensing reviewed one staff file and observed that, while staff's CRC was not expired, it was not addressed to this facility. The Manager said that she will submit an application to share CRC results and will notify Licensing when the application has been submitted.
Corrective Action(s): The Manager must ensure that all criminal record clearance letters are addressed to the facility prior to the hiring of staff.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of one staff's work history was not available during the inspection. Manager said staff's work history was obtained but cannot locate it during inspection.
Corrective Action(s): Please ensure all staff have a current resume on file and available during an inspection.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation (CORRECTED DURING INSPECTION): One staff file was missing immunization status. Manager said it was obtained but cannot locate it during inspection. This was corrected during inspection.
Corrective Action(s): Please ensure that all staff records are complete upon start of employment.

Comments

At the inspection dated January 25, 2024 there were seven children, Manager and one staff present. Licensing conducted a walk-through of the entire facility.The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by January 29, 2024 stating how the identified contraventions will be addressed to ensure year-round compliance. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following were discussed with the Manager:
Updating facility file with any changes made to the indoor or outdoor floor plan
Staffing exemption application process
Facility has spare bedding to replace children's soiled bedding
The inspection report was written on-site and details were reviewed with the Manager prior to writing the report. A copy of the follow up to routine inspection report and risk assessment is emailed to the manager on 25 January 2024 as Licensing officer's printer did not work.
