Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), and the Child Care Licensing Regulations (CCLR), and the Director of Licensing Standards of Practice (DoLSoP). All care categories were inspected for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: During the inspection, licensing observed staff certification was not displayed for one staff who works in the facility.
Corrective Action(s): Please ensure to display in permanent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the facility in the community care facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Storage of items in Infant nap room included, a box, and a plastic bag accessible to children while they sleep. In the toddler nap space there were storage items located next to a crib where children could reach them.
Corrective Action(s): Please ensure the nap rooms are free from storage items while children are using them.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11120 - CCLR s.15(2)(c) - A licensee must ensure that each piece of furniture or equipment for sleeping (c) is appropriate for the size, age and development of the children intended to use it.
Observation: Reclining infant chairs were stored in the nap room of both the Infant and Toddler room. Staff in both the Infant and Toddler rooms stated they have been using the infant chairs for children's nap.
Corrective Action(s): Please ensure to that each piece of furniture or equipment for sleeping is appropriate for the size, age and development for the children intended to use it.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Of six staff facility files reviewed, 3 had no site specific criminal record check, and 2 had no criminal record check completed by the provincial criminal records review program.
Corrective Action(s): Please ensure not to employ a person in a community care facility unless the licensee or, in the case of the manager, has first met with the person and obtained a criminal record check for the person.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Of six staff facility files reviewed, five had no evidence that the person has complied with the provinces immunization and tuberculosis control program.
Corrective Action(s): Please ensure to keep in staff facility files a declaration that the person has complied with the provinces immunization and tuberculosis control program.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Of nine children's records reviewed, one record was missing date of enrolment.
Corrective Action(s): Please ensure to keep record showing the date of enrolment.

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: of nine children's files reviewed, one file contained no parent consent to call a medical practitioner or ambulance in the case of accident or illness of the parent cannot immediately be reached.
Corrective Action(s): Please ensure to have in writing from a parent, and maintain at the community care facility, consent to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.

Comments

Summary of Inspection:
During today’s inspection, there were 23 children, 6 staff and a student present.
At this inspection the above noted contraventions were identified. Licensee is required to submit a corrective action plan to address the contraventions.

The following was discussed:

Discussed moving storage of diaper change supplies, away from counter food prep area, and storage of items that were located on the counter including printer and other items to provide a clear area for preparing food and bottles.
Discussed manager amendment, and posting.
Discussed a system to ensure references are checked by the manager or licensee.
Reviewed the systems for storage of bedding, and storage of the bedding.
Discussed systems for signing children into and out of each classroom when moving throughout the program classrooms.
