Introduction

An unannounced routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act, Child Care Licensing Regulation and the applicable Director of Licensing Standards of Practice. All areas of the facility were inspected for compliance except for the facility's policies and procedures as there have been no changes since the last routine inspection.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: There are 2 of 3 staff early childhood education certificates posted.

Corrective Action(s): Ensure all staff have their certificates posted.

STAFFING: 12110 - CCLR s.19(2)(b) - A licensee must not employ a person in a community care facility unless the licensee is satisfied, based on the information available to the licensee under subsection (1) and the licensee's or, in the case of an employee who is not the manager, the manager's own observations on meeting the person, that the person (b) has the personality, ability and temperament necessary to manage or work with children.
Observation: The Licensee has obtained references for staff however there is no evidence that the references have been verified.

Corrective Action(s): Licensing discussed with the Manager implementing a system that demonstrates they have verified staff's references.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing reviewed 3 staff files and none of the files contained evidence the early childhood educator's certificates have been verified.

Corrective Action(s): Licensing informed the Manager she will need to go on-line to the ECE Registry website to verify each staff's certificates and to place a copy of the verification on the staff's file. This must be done whenever the certificate has been renewed or additional certificates have been added.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: Upon review of 3 staff file Licensing noted one file contains a criminal record clearance letter addressed to another agency/employer.

Corrective Action(s): The Licensee must ensure that all criminal record clearance letters are addressed to them. Licensing discussed with the Manager about applying on line to have the results shared with them.

NUTRITION AND FOOD SERVICES: 17120 - CCLR s.48(6) - A licensee must make available to parents information on the food and drink given to children.
Observation: The facility provides morning and afternoon snack however there is no notification to families of what was served.

Corrective Action(s): Licensing discussed with the Manager the requirement of informing families, on a daily basis, what was offered to their child.

Comments

At the inspection dated, February 13, 2020, there were 2 staff and 8 children present. At this inspection the above noted contraventions were identified and any action required by the Licensee is included. As part of this routine inspection a Facility Risk Assessment Tool is completed and a copy is provided.

When the Licensing Officer reviewed the children's files it was noted that a child was enrolled when the child was 29 months of age. The Licensee is licensed to care for children ages 30 months to school age. In discussion with the Manager moving forward she will keep this mind when enrolling children.

Licensing was present during lunch and informed the Manager of a resource available regarding healthy eating and children's ability to make choices with regards to what they eat. This resource is 'Healthy Eating in the Child Care Setting - Division of Responsibility Model. The resource is beneficial to both child care staff and families and may be found on the web site listed below.
