Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): A spray bottle of cleaning solution was observed in an unlocked cupboard accessible to children.
Corrective Action(s): Please make sure children o not have access to hazardous substances. The bottle was moved out of children's reach during this inspection

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation (CORRECTED DURING INSPECTION): Hot water at the sink in the art area was measured at 58C. The Licensing Officer observed children hand washing at this sink. Children are not to have access to water hotter than 49c.
Corrective Action(s): Staff stated they will not use this sink to wash hands effective immediately.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A staff person who has been working at the facility since September has an RCMP criminal record check. The manager stated the criminal record check from the Criminal Records Review Agency was applied for about 1 week ago.
Corrective Action(s): Please make sure staff have a valid criminal record check from the Criminal Records Review Agency before they start work.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: References for one staff person have not been verified.
Corrective Action(s): Please make sure references for staff have been verified before the staff starts work.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: There is no evidence of an ECE certificate for 1 staff being validated.
Corrective Action(s): Please make sure all ECE certificates are validated through the ECE Registry before staff start work.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: One staff file does not have a record of immunization.
Corrective Action(s): Please make sure a record of immunization is available for all staff before they start work.

RECORDS AND REPORTING: 19230 - CCLR s.58(1)(c)(i) - A licensee must keep, for each child requiring extra support, a current care plan showing the following information: (c) the resources to be made available to the child requiring extra support by the licensee, including (i) any adaptation of the community care facility necessary to ensure the child's safety or comfort.
Observation: Medication indicated in a care plan for one child is not available. The manger stated the child may not need the medication and will clarify with the parents.
Corrective Action(s): Please make sure all medications named in a care plan are available.

Comments

At the inspection dated October 7, 2019 there were 13 children and 2 staff present. At this inspection the above noted contraventions were identified/no contraventions were identified. The Licensee will submit a written response outlining how the contraventions on this report have been addressed. The Licensing Officer will provide feedback as required.
