Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.
The following areas were reviewed:

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR #LJON-A9MU53 have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11160 - CCLR s.16(3)(a) - A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation: Licensing observed the green mesh fence in the children's outdoor play yard falling down presenting a falling hazard into the neighbours yard. Manager stated that she would like to get a new fence and will plan to apply for a grant. She plans to get the green mesh fenced repaired for now until a new fence is purchased.
Corrective Action(s): Ensure the play area is enclosed in a manner that will ensure children are free from harm and in a manner that is suitable for the age and development of the children. Please provide a plan to ensure children will be free from falling hazard when using the outdoor area.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: 1 of 3 sinks available to the children had a temperature of 59.9 degrees Celsius. Manager stated they will turn the hot water down on that sink and have a teacher assist the children in washing hands.
Corrective Action(s): Ensure heated water accessible to children is no more than 49 degrees Celsius.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: 3 of 6 staff files do not contain current criminal record checks. Manager stated that she was not aware that the criminal record checks were not current. Licensing officer provided a resource on completing criminal record checks on-line.
Corrective Action(s): Ensure staff have current criminal record checks.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: 9 of 15 children's files reviewed did not contain a photograph of the child. Manager stated she thought they took the photos but was unable to locate them. She said they will take the photos this week.
Corrective Action(s): Ensure each child has a photograph or digital image to readily identify children.

Comments

Discussed the recent changes to the CCLR as well as the new DOLSP regarding “Active Play” with the facility manager. These changes include:
· Removal of requirement for pre-employment doctor’s note
· Requirement for licensee to validate staff credentials through the ECE Registry website and to keep a record on file related to individual staff ECEA, ECE, I/T ECE and/or SN ECE validations
·Requirement for licensee to develop new policies related to “Active Play” and “Screen Use”.
