Introduction

All care categories were inspected during an unscheduled routine inspection to assess compliance w/:
• the Community Care & Assisted Living Act (CCALA)
• the Child Care Licensing Regulation (CCLR)
• relevant Director of Licensing Standards of Practices (DLSP)

Observed Violations
STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: *Repeat violation from FIR #CGEE-ANQTG8 (27/Jun/2017), FIR #CGEE-AZHTC6 (07/Jun/2018), FIR #CGEE-BDFTAE (24/Jun/2019), & FIR #CGEE-BNGSBU (07/Apr/2020)*

An employee's CRC is addressed to another organization. The manager explained that she recently applied for this employee's CRC share.
Corrective Action(s): All requirements under CCLR s.19 must be obtained by employee's 1st day of employment. In the meantime, this employee can't work alone w/ children or assist w/ toileting/diapering.

STAFFING: 12430 - CCLR s.56(1)(b) - A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation: 2 employees' CRCs expired. The manager explained that she recently applied for this employee's CRC share.
Corrective Action(s): All requirements under CCLR s.19 must be obtained by employee's 1st day of employment. In the meantime, these employees can't work alone w/ children or assist w/ toileting/diapering.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.

The fire extinguishers' annual service date was by 15/Jan/2022.
Corrective Action(s): Please obtain servicing for the fire extinguishers.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The manager explained that the facility practiced implementing the emergency plan recently; however, there's no record of it.
Corrective Action(s): The manager stated that she'd speak w/ employees to determine when it occurred.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: 2 children's MSP #s weren't documented (1 of these children's files had a sticky note from fall 2021 re. follow-up).
Corrective Action(s): All requirements under CCLR s.57(2) must be obtained by children's 1st day of care.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: *Repeat violation from FIR #CGEE-AZHTC6 (07/Jun/2018), FIR #CGEE-BDFTAE (24/Jun/2019), & FIR #CGEE-BNGSBU (07/Apr/2020)*

5 children's start dates were missing or unclear.
Corrective Action(s): All requirements under CCLR s.57(2) must be obtained by children's 1st day of care.

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.

Summary of FIR #CGEE-CDERNN (14/Apr/2022)

1 violation was corrected during the inspection & corrective action for 7 remaining violations includes:
• obtaining employee documentation
• obtaining servicing for the fire extinguisher
• documenting the annual emergency drill's practice date
• obtaining children documentation

FHA discussed key points from BCCDC's "Public Health Guidance for Child Care Settings" (http://www.bccdc.ca/Health-Info-Site/Documents/COVID_public_guidance/Guidance_Child_Care.pdf).

FHA reviewed the inspection w/ the manager; however, FIR #CGEE-CDGRQN & the facility risk assessment tool were completed @ the Burnaby Health Protection office & emailed to the manager on 14/Apr/2022.
