Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR # have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: In baby room:
A large size white board was noted to put above the washroom hand sink. The board was not secured and it may tip over.
3 tall shelves were not secured and they may tip over.
Electric sockets were not protected and children may have access to them.
Corrective Action(s): Please ensure all items that have potential to fall or tip over must be secured. Please ensure children have not access to electric sockets.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation (CORRECTED DURING INSPECTION): 4 staff files were reviewed. A staff's references were missing from file.
Corrective Action(s): Please ensure to obtain at least two references from staff upon hiring.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: 4 staff files were reviewed. A staff's immunization was missing from their file.
Corrective Action(s): Please ensure to obtain all staffs' immunization upon hiring.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: The fire drill records were reviewed. Fire drills were conducted monthly. The manager stated that emergency drill has conducted once, however, it was not recorded.

Corrective Action(s): Please record all emergency drills.

CARE AND/OR SUPERVISION: 14020 - CCLR s.34(2)(a) - Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation: A child > 36 months was placed in the IT program.

Corrective Action(s): Recommend to submit a temporary placement request to support this child's needs. The manager agreed to submit the request by Jan 26, 2018

RECORDS AND REPORTING: 19090 - CCLR s.57(2)(c) - A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation: Attendance sheets were reviewed. The record of children's absent, present, time of arrival and departure were not maintained or were missing.

Corrective Action(s): Please develop a system to record and maintain children's absent, present, time of arrival and departure.

Comments

The following were discussed:

1. Validation of ECE certificate. Please ensure that all ECEs' certificates are validated (ECE registry website) and the proofs are kept in their files.
2. The manager was aware that some of the parents have not completed or provided the requirement information I.e. immunization and she stated that she has been following with those parents.
3. The outdoor playgrounds are power washed on a regular basis. Please monitor the wooden platform of the climbing structure to ensure they are safe and not slippery.
4. The new Director of Licensing Standard of Practice - Active Play was discussed. It appeared that the active play has been incorporated into the program and the manager was aware of the active play and screen use requirements. The manager agreed to follow up further with the written policies and to share with policies with the families.
