Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Licensing observed the following in the outdoor area:
-A BBQ was accessible
-A ladder leaning against the house. This could present a potential falling hazard
A gate was placed in front of these items but the gate was not fixed and was easy to move.
-a sharp rose bush

Licensing observed the following in the indoor play area:
-A large climber. Six foot clearance around equipment, as recommended in the Director of Licensing Standards of Practice-Safe Play Space is considered the safest. The Licensee stated that she will move this climber outside.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times the children are in care.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Licensing reviewed three staff records of three. One staff record had no character references.
Corrective Action(s): Please ensure staff records are complete.

POLICIES AND PROCEDURES: 13060 - CCLR s.56(1)(d) - A licensee must keep current records of each of the following: (d) written policies and procedures that are intended to guide employees in the care and supervision of children.
Observation: During the inspection licensing reviewed the policies for the facility. An active play policy was not observed. This is a repeat contravention from inspection # CLAN-BL9NQ5.
Corrective Action(s): Please ensure an active play policy is created, implemented and shared with the families to maintain compliance with the Director of Licensing Standards of Practice-Active Play.

MEDICATION: 16030 - CCLR s.53(2)(a) - A licensee must ensure that a child's medication is not accessible to any child, except that a child may have access to his or her own medication if (a) the child's parent has instructed the licensee to permit this.
Observation: During the inspection licensing observed that a child's emergency medication was placed in their backpack in a cubby area. This cubby area was located at the children's level. This is a serious health and safety concern to the children in care. This is a repeat contravention from inspection # CLAN-BL9NQ5
Corrective Action(s): Please ensure emergency medication is not accessible to any of the children in care.

RECORDS AND REPORTING: 19190 - CCLR s.57(3)(a) - A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation: Four of eight children's records were reviewed. Two children's records were missing consent to call an ambulance or a medical practitioner in an emergency.
Corrective Action(s): Please ensure children's records are complete.

RECORDS AND REPORTING: 19260 - CCLR s.58(2)(b) - The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation: A care plan was observed for a child who requires medication in an emergency. The plan has not been reviewed on an annual basis. In addition the emergency medication has expired
Corrective Action(s): Please ensure the emergency plan is reviewed on an annual basis and that this is documented.

Comments

At the inspection dated March 4, 2021 there were 7 children two staff and the Licensee/Manager was present. At this inspection the above noted contraventions were identified. Please ensure the above noted contraventions are corrected by March 24, 2021 . As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Licensee.

The following education/recommendations were provided:

-The reportable incident reporting procedure.
-The current COVID-19 protocols that are in place
-Several items in the first aid kit had a drug identification number (DIN) or a natural product number (NPN). Please ensure a medical authorization form is filled out prior to application.
-Adding more items to the first aid kit and the emergency evacuation kit.
-Installing a second lock on the gate at the top of the stairs to the entrance.
-Active supervision
-Posting more information in the fire drill plan

The inspection findings were reviewed with the Licensee at the inspection. Due to the COVID-19 pandemic the inspection report and the risk assessment were completed at the Burnaby FHA office. The report was written in 1 hour and this is included in the report. A copy of these documents were sent to the Licensee.
