Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). All areas of the facility were inspected for compliance.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: During inspection licensing observed secondary exit was partially hampered with several stored metal fences.This is a repeat contravention from inspection #SMIA-CH6TAU dated 10 August 2022 & inspection # SMIA-CK7NLY dated 14 October 2022.
Corrective Action(s): Please ensure that all emergency exits are clear of equipment, furniture, and supplies that could obstruct or hamper an exit in the event of a fire or other emergency.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Evidence of reference being checked was not available for two staff.
Corrective Action(s): Ensure that character references are obtained and verified for each employee before they start employment.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation (CORRECTED DURING INSPECTION): Upon a review of five staff records, Licensing observed that two staff's certificate has not been verified through the early childhood educator registry.During the inspection, staff validated these two certificates, and Licensing was able to review them. This is a repeat contravention from routine inpsection #SMIA-C44QVR dated 18 June 2021.
Corrective Action(s): Please ensure ECE Certificates are verified and evidence of the verification is available before a staff begins employment.

Comments

At the inspection dated November 20, 2023, there were forty-four children, six staff and the manager present. At this inspection the above noted contraventions were identified. Licensing conducted a walk-through of the entire facility. The Manager will take action to bring the facility into compliance and provide a written response to the Licensing Officer by November 24, 2023 stating how the identified contraventions will be addressed to ensure year-round compliance. The Licensing Officer will review the response. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy is provided.

The following were discussed with the Manager:
Ensure that the outdoor gate latching devices are securely latched
The doors to the bathroom wall cabinets must be securely closed to prevent items stored in them from falling out in the event of an earthquake.

The inspection report was written off-site and details were reviewed with the Manager prior to writing the report. A copy of the follow up to routine inspection report and risk assessment is provided to the manager on 21 November 2023.
