Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes non-compliance identified during the routine inspection and a 3 year “historical” review of the facility’s compliance and operation.

Contraventions
Previous Inspection - Contraventions observed on FIR #JCHE-A65SJ9 have been corrected except for those noted on supplementary pages.
Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11180 - CCLR s.16(4)(a) - A licensee must ensure that all indoor and outdoor play materials and equipment accessible to children are (a) suitable for the age and development of the children.
Observation: Licensing observed that the available toys in the classroom were geared towards a preschool aged child. The classroom is used for preschool aged children but after school the program is licensed as an out of school care. There is 1 long shelf with toys such as, pretend food, duplo blocks, toddler trucks and potato heads. The other shelf has a small amount of games geared for older children but the amount of toys were not appropriate to the age and development of the children in care that were present at this time. This was evidenced by children standing on the small chairs, wandering and climbing the shelving. The staff stated that there was another shelf with toys but it was closed off to use at the time of inspection. Licensing notes that this is a shared space.
Corrective Action(s): Please ensure that the toys and equipment available for children are age and developmentally appropriate to the children in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): Upon Licensings arrival it was found that there was a "heat dish" heater placed on a chair in the classroom. This was in direct reach of children. Two children were touching the heater while not in use. The staff stated that it was provided by the Licensee contact for additional heat in the classroom. This heater heats up to a temperature which would make the heater itself extremely dangerous if a child was to touch it. It could cause extreme burns or become a fire hazard if it was tipped over. The staff stated that they have only used it once or twice. Upon Licensing arrival on Dec 13, the heater had been removed.
Corrective Action(s): Please ensure that children do not have access to any object or substance that may be hazardous to the health and safety of a child.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Licensing reviewed 3 staff files and it was identified in 2 of the files that there was no evidence that the certificate of each staff has been verified through the ECE Registry as required. Staff stated that they were not aware that this was a requirement.
Corrective Action(s): Please ensure that any staff that holds a certificate must be verified by the Licensee using a system established and maintained by the director of the Early Childhood Registry.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must have all of the following: (b) an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Licensing reviewed the evacuation plan and it indicated that the facility provides food, water and supplies for up to 72 hours in an emergency. Licensing observed that there was no food or limited water supplies available in the emergency bin. The supply list documentation stored in the bin indicated that it was last checked by staff in Sept 2013. The staff present stated that she had not checked the bin but thought that the other staff person had done so. Staff stated that there were some crackers in the cupboard, Licensing observed 3 small boxes.
Corrective Action(s): Pleases ensure that there are adequate supplies available as indicated in your emergency plan to prepare for, mitigate, respond to and recover from an emergency.

POLICIES AND PROCEDURES: 13050 - CCLR s.56(1)(c) - A licensee must keep current records of each of the following: (c) a record respecting compliance with section 22 (2) (b) and (c) [emergency training and equipment].
Observation: Licensing reviewed the record of completed fire drills. The documentation indicated that neither program had completed or recorded a fire drill in Sept 2016 or Nov 2016. Staff was unaware if they were completed or not.
Corrective Action(s): Pleases ensure that a record of compliance with Section 22(b) and (c) is kept.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Licensing reviewed 6 children's files and it was found that 1 child was missing a medical insurance plan number. Staff stated that they will follow up with the parents as soon as possible.
Corrective Action(s): Please ensure that all files are complete and up to date as required.
