Introduction

An unscheduled routine inspection was conducted on July 25, 2022 to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All care categories were reviewed for compliance.

Observed Violations
LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Upon inspection, 3 staff certificates were not posted in the facility.
Corrective Action(s): Please ensure certificates are posted in a prominent place in the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11010 - CCLR s.13(1) - A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation: Upon inspection there was a blind cord accessible to the children and a rope tied to the climber outside that posed a strangulation hazard.
Corrective Action(s): Please ensure a healthy and safe environment is provided at all times that children are in care.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): Upon inspection there was a spray bottle of cleaning solution accessible to the children in care.
Corrective Action(s): Please ensure that children do not have access to any substance that may be hazardous to the health and safety of a child.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Upon review of the staff records, 2 staff did not have references on file.
Corrective Action(s): Please ensure character references are obtained.

STAFFING: 12060 - CCLR s.19(1)(c) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (c) a record of the person's work history.
Observation: A record of the person's work history was not obtained for one or more employees.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for one or more employees.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation: Upon review of the staff records, 3 staff did not have their certificates verified by the system maintained by the early childhood registry.

POLICIES AND PROCEDURES: 13020 - CCLR s.22(1)(b) - A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation: Upon inspection the 2 fire extinguishers were over due for their yearly inspections.
Corrective Action(s): Please ensure the fire extinguishers are maintained.

RECORDS AND REPORTING: 19070 - CCLR s.57(2)(a) - A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation: Upon review of the children's records, 2 files were missing medical numbers and 1 was missing an immunization status.
Corrective Action(s): Please ensure the children's files are complete.

RECORDS AND REPORTING: 19080 - CCLR s.57(2)(b) - A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation: Upon review of the children's records, 3 children's files did not contain a start date.
Corrective Action(s): Please ensure the children's files are complete.

RECORDS AND REPORTING: 19100 - CCLR s.57(2)(d) - A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation: Upon review of the children's records, 3 files did not contain a doctors name and 1 file did not have emergency contacts listed.
Corrective Action(s): Please ensure that the children's files are complete.

RECORDS AND REPORTING: 19160 - CCLR s.57(2)(i) - A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation: Upon asking the Manager to see a photograph of the children or a digital image, the Manager said that she did not have one for one of the children.
Corrective Action(s): Please ensure children's files are complete with a photograph or digital image of the child.

Comments

At the inspection dated July 25, 2022 there were 15 children and 4 staff present. At this inspection the above noted contraventions were identified. The Licensee will provide Licensing with a written response.Licensing will review the response. As part of this Inspection a Facility Risk Assessment was completed and a copy was provided.

Licensing conducted a walk-through of the entire facility.

The information contained in the report was discussed with the Manager and Licensing stated that the report will be emailed to the facility.
