Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care and Assisted Living Act (CCALA), the Child Care Licensing Regulations (CCLR) and the relevant Director of Licensing Standards of Practice (DLSP). All areas of the facility were inspected for compliance.

Observed Violations
LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: The Managers name was not posted in the facility. This is a repeat contravention from inspections: #CLAN-CD8M9B

Corrective Action(s): Please ensure the Manager's name is posted in a prominent place.

LICENSING: 10070 - CCLR s.11(4) - A licensee must display in a prominent place in the community care facility the certificate, or a copy of the certificate, of any educator or assistant employed to work in the community care facility.
Observation: Two staff certificates were not posted for staff working in the facility. This is a repeat contravention from inspection #CLAN-CD8M9B, #CLAN-CEJLZL, #CLAN-CFPT8Z
Corrective Action(s): Please ensure staff certificates are posted in a prominent place.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11020 - CCLR s.13(2) - A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation: Licensing observed the landscape fabric in the outdoor play area was exposed. This could present a potential tripping hazard. This is a repeat contravention from inspection #CLAN-CD8M9B, #CLAN-CEJLZL, #CLAN-CFPT8Z.
Corrective Action(s): Please ensure the facility is in good repair.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: During the inspection a plastic kitchen unit was placed beside the emergency exit. This was partially blocking the emergency exit. This was corrected during the inspection
Corrective Action(s): Please ensure no equipment blocks or partially blocks the emergency exit to ensure a safe exit in case of emergency.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation: During the inspection the following was observed:
-The laundry room door was unlocked. A lock was present but it was not applied. A stool was in the laundry room with access to various cleaning products. This is a repeat contravention from inspection #CLAN-CD8M9B, #CLAN-CEJLZL, #CLAN-CFPT8Z
-The cabinet under the sink in the washroom was unlocked. A lock was present but not applied. Bleach, Toilet bowl cleaner and disinfectant spray were accessible. This was corrected during the inspection.
-Staff bags and purses were within easy reach in the kitchen.
Corrective Action(s): Please ensure children do not have access to any objects or substances that may be hazardous to their health and safety.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11230 - CCLR s.47 - A licensee must ensure that any heated water accessible to children is heated to no more than 49° Celsius.
Observation: Licensing measured the water temperature in the washroom where children wash their hands. The temperature was 50.1 Degrees Celsius.
Corrective Action(s): Please ensure the water temperature does not exceed 49 Degrees Celsius to meet the legislative requirement and ensure the health and safety of children in care. Please provide active supervision in this area until this is corrected.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: Two staff records were reviewed. One staff did not have a criminal record check in their record. The health and safety risk was discussed. This is a repeat contravention from inspection #CLAN-CEJLZL
Corrective Action(s): Please ensure all staff records are complete prior to employees starting their first date of work.

STAFFING: 12050 - CCLR s.19(1)(b) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation: Two staff records were reviewed. One staff was missing 2 character references. This is a repeat contravention from inspection #CLAN-CEJLZL, #CLAN-CFPT8Z
Corrective Action(s): Please ensure staff records are complete prior to a staff starting work at the facility.

STAFFING: 12070 - CCLR s.19(1)(d) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation: Two staff records were reviewed. Two certificates as evidence of the person's training and skills were not obtained. This is a repeat contravention from inspection #CLAN-CD8M9B, #CLAN-CEJLZL
Corrective Action(s): Please ensure staff records are complete.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: During the inspection Licensing observed the staff records. One staff was certified to work as an Early Childhood Educator (ECE) in Alberta while the other staff stated she was an ECEA. In discussion with the Director she confirmed the staff ECEA certificate was expired.The facility staff were qualified to work in British Columbia as Responsible Adults One Certified ECE Educator is required to provide care to the children to ensure the ratio of staff to children is met according to the Legislative requirements outlined in Schedule E of the Child Care Licensing Regulation.
Corrective Action(s): Please provide adequate staffing to ensure the health and safety of children in care and meet the legislative requirements. A staffing plan is required to be submitted to Licensing by April 6, 2023.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: During the inspection Licensing observed the following:
-The Manager's record was not at the facility. In discussion with the Director she stated that the Manager left the facility for a temporary absence on March 31st and she took her staff record with her. This is a repeat contravention from inspection #CLAN-CD8M9B, #CLAN-CEJLZL, #CLAN-CFPT8Z .
-A child's record was not at the facility. The serious health and safety risk was discussed with the Director.
Corrective Action(s): Please ensure the Manager's record and the children's records are onsite at all times.

Comments

At the inspection dated April 5, 2023 there were 8 children, 2 staff, and the Director arrived during the inspection. The Manager was not present. At this inspection the above noted contraventions were identified. Please correct the above noted contraventions by April 19, 2023 unless otherwise specified in the report. As part of this Routine Inspection a Facility Risk Assessment Tool is completed and a copy was sent to the Director.

The following was discussed:
-The reportable incident reporting procedure. Forms and the bulletin were given
-The current cleaning protocols that are in place
-Preventing lead in the water

The following education was provided:
-Creating systems for maintaining staff records and appropriate staffing levels. The staff qualifications list was given to the Director
-Creating systems for children's records
-Creating systems to complete daily health and safety checks at the facility.

The Director is requested to submit a written staffing plan to Licensing by April 6, 2023 at 9:00 am.

The inspection findings were reviewed with the Director at the inspection. The facility inspection report was written off-site due to technical difficulties. The inspection report was reviewed with the Director by phone on April 5, 2023. A copy of these documents were sent to the Director.
