Introduction

An unscheduled routine inspection was conducted to assess compliance with the Community Care & Assisted Living Act (CCALA), the Child Care Licensing Regulation (CCLR) and the relevant Director of Licensing Standards of Practice (DOLSP). Evidence for this report was based on the Licensing Officer’s observations, review of the facility records and information provided by the facility staff at the time of inspection.

As part of the routine inspection a Facility Risk Assessment Tool is completed and a copy is provided. The Risk Assessment includes noncompliance identified during the routine inspection and would also include a 3 year “historical” review of the facility’s compliance and operation , however this is the first routine conducted at the facility ( 3 year history unavailable )

Active and Ongoing Supervision
Fraser Health Licensing is responding to a number of incidents that have involved children going missing or being unsupervised. These types of events can have serious consequences and requires all care providers to take steps to ensure they actively supervise children at all times. Active Supervision, policies and procedures, and design/arrangement of children’s environments, can prevent or reduce the likelihood of accidents and serious injuries.

· Remember: In the event that a serious incident does occur you must report to Licensing within 24 hours. Contact the licensing officer assigned to your facility or phone Fraser Health central line at 604-587-3936 and ask to speak to the Duty Licensing Officer.

Current Inspection - Items reviewed comply with the Act, regulations & standards of practice except for those noted on supplementary pages.

Observed Violations
LICENSING: 10010 - CCLR s.10(1) - Applicants for licences and licensees must notify a medical health officer immediately of any change in the information provided under section 9.
Observation: Transportation Permission Forms signed with parents consent in order for staff to transport children. The form includes that field trips are an integral part of the program however during the application process Licensing was advised that transportation would not occur therefore a Transportation Policy was not requested to be developed.
Corrective Action(s): Licensing must be notified of any change to the information provided under section 9 which would include changes to programming such as transporting children. Please provide a copy of your transportation policy for review.

LICENSING: 10050 - CCLR s.11(1) - A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager.
Observation: Name of the manager was not posted within the facility
Corrective Action(s): Ensure the name of the manager is posted in an prominent place within the facility.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11090 - CCLR s.15(1)(b) - A licensee must supply equipment, furniture and supplies that are (b) located so as not to block or hamper an exit in the case of fire or other emergency.
Observation: At arrival the staff and children were engaged in outdoor play within the fenced yard , Licensing requested to enter however a combination lock was in place on the gate to which the staff could not open stating she did not remember the code. It is noted that this is identified in the Fire safety Plan as the means of aggress from the yard.
Corrective Action(s): Ensure exits are clear in order to assist in the safe evacuation in the event of a fire or emergency.

PHYSICAL FACILITY, EQUIPMENT AND FURNISHINGS: 11200 - CCLR s.17 - A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation (CORRECTED DURING INSPECTION): Observed the following hazardous accessible to children: It is noted that one cabinet was equipped with a latch however it was not secured in place.
1. Bleach and plastic bags located under the sink
2. Clorox wipes located under the washroom sink
3. Knife in the sink
4. Exposed electrical outlets ( x 2 )
5. Blind cords - hanging down in a loop at children's level
6. Lighter located within a drawer
Corrective Action(s): The licensee secured the products and addressed the hazards as they were pointed out by Licensing during the inspection.
Discussed the importance of being proactive in ensuring children do not have access to substances or items that may pose risk of harm.

STAFFING: 12040 - CCLR s.19(1)(a) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation: A review of staff records concluded that a criminal record clearance had not been obtained prior to employment.
Corrective Action(s): ensure screening is complete with required documentation ( including CRC ) in place prior to staff working with the children.

STAFFING: 12090 - CCLR s.19(1)(f) - A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation: Immunization status was not obtained for 1 staff working within the Community Care Facility.
Corrective Action(s): ensure screening is complete prior to staff working , to include immunization status.

STAFFING: 12120 - CCLR s.19(2)(c) - A licensee must not employ a person in a community care facility unless the licensee is satisfied, based on the information available to the licensee under subsection (1) and the licensee's or, in the case of an employee who is not the manager, the manager's own observations on meeting the person, that the person (c) has the training and experience and demonstrates the skills necessary to carry out the duties assigned to the manager or employee.
Observation: Staff working alone with the children at Licensing arrival , the staff was unable to produce copies of the children's registration files including she was unaware of their location.
Corrective Action(s): Ensure staff are trained and hold the required experience in order to carry out the duties assigned.

STAFFING: 12140 - CCLR s.19(4)(a) - A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the licensee using a system established and maintained by the director of the early childhood educator registry,
Observation: Staff working alone with the children as the manager was off site , the staff does not hold a ECE Certificate.
Corrective Action(s): A licensee must not employ a person as an educator who does not hold the required Certificate issued by the Early Childhood Education Registry.

STAFFING: 12190 - CCLR s.22(2)(b) - A licensee must ensure that each employee (b) practices implementing the fire drill system at least once each month.
Observation: A fire drill log sheet was located however was not in use, licensee stated that a drill had been conducted however not recorded.
Corrective Action(s): Ensure each employee practices implementing the fire drill system at least once per month to promote safe evacuation in case of an emergency

CARE AND/OR SUPERVISION: 14010 - CCLR s.34(1) - A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation: Staff working alone with children is not an Early Childhood Educator and is therefore determined an unqualified employee.
Corrective Action(s): A licensee must ensure children are adequately supervised by qualified employees

Comments

A Temporary Placement in place - at review of the application it is found that the plan as described by the licensee is not being implemented - A copy of the application was provided to the licensee during the delivery of the report , highlighted sections include the licensee's commitment to provide sufficient staffing , work closely with staff and to work alongside an assistant staff when the child is in attendance. - Provide within your written response what steps you will implement to ensure the plan as provided is being implemented.

Provided a copy of the Child Care Checklist - Due to the number of contraventions including unsafe storage practices and concerns related to Staffing a follow up inspection will occur.
